FBI gun check breakdown allowed Dylann Roof to buy weapon

Charleston gunman Dylann Roof should never have been been able to buy the gun he used to kill nine worshippers at a church Bible study last month, the FBI director said Friday, citing a breakdown in the national background check system.

A loophole allowed the 21-year-old to buy the .45-caliber handgun with money given to him for his birthday despite a criminal record that included a recent drug possession charge, James Comey said.

Roof opened fire inside the Emanuel A.M.E. Church in Charleston on June 17, killing nine in what authorities believe was an attack motivated by racial hatred. He was arrested the next day in Shelby, N.C.

The FBI’s National Instant Criminal Background Check System, which does instant background checks for 30 states, should have flagged Roof on April 11, when he went to a West Columbia gun shop to guy the firearm, Comey said. But because of a series of errors, including one on Roof’s rap sheet, the examiner performing the check on Roof did not know he had admitted to drug possession in a March 1 incident, which should have rendered him an “unlawful user” ineligible to purchase the gun.

In addition to the rap sheet, there was an error on another document, which failed to reflect the geography of the area. Had the document been in order, the examination might have included contacting relevant local law enforcement agencies, including ones with records of the drug possession charge.

The background check turned up the March 1 arrest in Lexington County for drugs, but did not reveal that Roof subsequently admitted to the charge. The arrest alone would not have been sufficient to deny the sale, but an admission or conviction would have.

The background check for Roof’s application was marked “delayed pending,” and when there was no update for three days, the gun shop had the legal right to complete the transaction. Comey said most large chains wait for a completion of the check even if it is delayed, but said smaller retailers do not always wait, and are not required to.

It is not known why Roof opened fire inside the landmark church, which traces its roots to 1816 when African-American members of the city’s Methodist Episcopal Church, led by a freed slave, broke away to form their own congregation. But he was reported to have made several racially charged threats before shooting the worshippers, who included pastor and state Sen. Clementa Pinckney, and Roof had posted several hate-filled missives on the web, including pictures of him with the Confederate flag and symbols of South African apartheid.

Again we have laws in place but they did not work right and how is more laws going to change that? And criminals will get them regardless, That is what makes them criminals…….

Witnesses stop attempted rape of 14-year-old girl

Springfield police say three witnesses followed a 14-year-old girl’s screams along a dark trail, pulled a would-be rapist off her and held the man down until officers arrived.

Three friends were parking their car at a Greenway Trail near Wilson’s Creek on Thursday night when they heard a girl screaming for help, according to a probable cause statement.

The three friends followed the sounds of the screams, using a cell phone as their flashlight, until they found a man later identified as Christopher Muller wearing only his boxers lying on top of the girl, according to the statement.

The friends rushed in and pulled Muller off the girl and — after what documents describe as a small scuffle — detained him until police arrived, the statement says.

Police arrested Muller, 22, and he was charged Friday with rape or attempted rape and attempted statutory rape. He is being held in the Greene County Jail on $250,000 bond.

The statement says the 14-year-old victim was in stable condition after the attack, but she was “completely unresponsive.” Police said she was either under the influence of something or in extreme shock.

Police interviewed Muller on Friday in jail and he told them the girl — who he thought was 15 — was “hot” but he denied raping her, according to the statement.

Muller told police he and the girl had gone to the park that night with another friend. He said he had gone swimming, which is why he was wearing only his boxers when police arrived, according to the statement.

Muller told police all he remembered was walking back toward the car after swimming when he was tackled by someone. He said he was not sure who tackled him because he was not wearing his glasses, according to the statement.

Muller does not have an attorney listed for this case.

Omar Sharif: Lawrence of Arabia star dies aged 83

Actor Omar Sharif, best known for his roles in classic films Lawrence of Arabia and Doctor Zhivago, has died aged 83.

Egypt-born Sharif won two Golden Globe awards and an Oscar nomination for his role as Sherif Ali in David Lean’s 1962 epic Lawrence of Arabia.

He won a further Golden Globe three years later for Doctor Zhivago.

Earlier this year, his agent confirmed he had been diagnosed with Alzheimer’s disease.

His agent Steve Kenis said: “He suffered a heart attack this afternoon in a hospital in Cairo.”

Spanish actor Antonio Banderas, who appeared with Sharif in 1999 film The 13th Warrior, remembered him on Twitter as “one of the best”.

Sharif started his career in Egyptian cinema in the 1950s

Born Michel Shalhoub in Alexandria in April 1932, Sharif started out in his family’s lumber business before going to London to study at the Royal Academy of Dramatic Art (Rada).

He made his screen debut in the 1954 Egyptian film Siraa Fil-Wadi (The Blazing Sun) and rapidly became a star in his own country.

His big break came when David Lean cast him in Lawrence of Arabia, introducing the actor with a now-legendary shot of him riding a camel out of a shimmering heat haze towards the camera.

Peter O’Toole, who played TE Lawrence in the 1962 multiple Oscar-winner, considered Sharif’s name ridiculous and insisted on calling him “Fred”. The pair soon became fast friends.

In later life Sharif claimed to be baffled by the film’s success, saying it had merely been shots of people on camels walking from one side of the screen to the other.David Lean went on to cast Sharif in the title role of his next epic Doctor Zhivago, in which he played a physician caught up in the Russian Revolution.


The actor went through a daily routine of hair-straightening and skin-waxing in order to disguise his Egyptian looks and would later admit the film had left him close to a nervous breakdown.

Other notable roles came opposite Barbra Streisand in her first film Funny Girl and as Julie Andrews’ lover in spy thriller The Tamarind Seed.

He also got to play a series of real-life figures, among them Genghis Khan and the Argentine revolutionary Che Guevara.

After his initial stint in the spotlight, Sharif would come to be seen more frequently at the gaming tables than the Hollywood soundstage.

He became particularly successful at bridge and was ranked among the world’s best players.

His film roles became increasingly sporadic, and those he did accept were in films he would later dismiss as “rubbish”.

In the late 1990s Sharif began declining film offers, claiming he had lost his “self-respect and dignity”.

He won a Career Golden Lion at the Venice Film Festival in 2003

One film he did accept was 2003 French drama Monsieur Ibraham, in which he appeared as a Muslim shopkeeper in Paris who adopts a Jewish boy.

The film won him the Cesar, the French equivalent of the Oscar, as well as some of his best reviews in decades.

Sharif suffered a public embarrassment in 2007 after punching a parking valet who refused to accept his European currency.

The actor pleaded no contest to misdemeanour battery and was ordered to take an anger management course.

Sharif spent much of his later years in Cairo and at the Royal Moncean Hotel in Paris, though he occasionally travelled to Hull to support his favourite football team, Hull City.

The actor, who was introduced to the Tigers by his Doctor Zhivago co-star Sir Tom Courtenay, was given an honorary degree by the University of Hull in 2010 as a reward for his loyalty.

He retreated from the spotlight after being diagnosed with Alzheimer’s

Earlier this year his agent confirmed he had been diagnosed with Alzheimer’s disease after his son Tarek gave an interview in which he discussed his father’s deteriorating condition.

“He still knows he’s a famous actor,” Tarek El-Sharif told Spain’s El Mundo newspapaer. “He remembers, for example, [he was in] Doctor Zhivago but he’s forgotten when it was filmed.”

Following the announcement of Sharif’s death, his grandson Omar Sharif Jr posted a picture of him on Facebook with the simple caption: “I love you.”

A Michigan judge sent three children to a juvenile detention facility after they refused to make an effort to have a relationship with their father, reports CBS Detroit.

Oakland County Circuit Judge Lisa Gorcyca last month declared the children — ages 9, 10, 15 — in civil contempt of court. The children were then taken into custody and hauled off to Children’s Village, a detention and treatment facility in Pontiac for youth.

The children’s parents, Maya Eibschitz-Tsimhoni and Omer Tsimhoni, have been entangled in a bitter divorce for six years, according to the station. The Bloomfield Hills couple, who married in 1995, have reportedly made dozens of court appearances regarding parenting time, therapy, schooling and other issues — but have never reached a common ground.

During a June 24 hearing, Judge Gorcyca told the children that their father has “gone through hoops” to maintain a relationship with them, despite having issues with their mother. The judge reportedly insisted the children make an effort to talk to their father, who suggested they have lunch together. Still, the children refused, according to the station.

“I ordered you to talk to your father. You chose not to talk to your father. You defied a direct court order. It’s direct contempt so I’m finding you guilty of civil contempt,” Gorcyca told the 15-year-old boy in court that day, according to the Oakland Press.

“You’re very defiant. You have no manners,” the judge reportedly added. “You need to do a research program on Charlie Manson and the cult that he has…. You are so mentally messed up right now and it’s not because of your father. And one day you are going to realize what’s going on in this case and you’re going to apologize to your dad.”

The judge then turned her attention to the father, Omer Tsimhoni, saying, “Dad, if you ever think that he has changed and he’s no longer like Charlie Manson’s cult, then you let us know.”

The 9-year-old boy and 10-year-old girl also refused to have a meal with their father, instead opting to go to the detention center.

“I’ve never seen anything like this,” Gorcyca said, reports CBS Detroit. “One day you can watch this video and realize that you two have been brainwashed…. This is not normal behavior. No adult in this courtroom, except one, thinks this is normal. Every single adult in this courtroom thinks you have been brainwashed.”

Omer Tsimhoni’s attorney, Keri Middleditch, called the situation traumatic for everyone involved.

“Dr. Eibschitz-Tsimhoni has continued to endorse the children’s behavior that she successfully instilled in them, effectively alienating them from their father. The court took severe action to attempt to remedy a heart-wrenching situation,” Middleditch said in a statement.

Each child has been appointed an attorney by the judge and one of those attorneys has since objected to the judge’s order.

CBS Detroit reports officials at the detention facility have been instructed by the court to keep contact between the siblings to a minimum and the children’s mother and her relatives have reportedly been prohibited from visiting the facility.

An emergency hearing concerning the children’s near future has been set for July 15.
