It wasn’t long to wait to see more hate
After my surprise visitor this morning I was really on top of my game today it really made my day, and again I want to say thank you, the mad dog looks that only someone that has a lot of hate inside of them means absolutely nothing to me but maybe it works with that puppet you have on a leash that was with you.
The afternoon session started with Beverly Woody again talking about statements Robert had made to her, and they began talking about a visit that she received from Bobby Atwal and a couple other people where they were trying to discuss what it occurred and she also stated that there was an attorney on the phone wanting to talk to her. Again during this testimony judge Zuniga had to advise Mme. Dist. Atty. the proper procedures of laying a foundation and asking questions. It was never made clear which attorney was on the phone and they only talked on the porch briefly and never went in the house.
Mme. DA started going to a line of questioning which Raising multiple objections, and I’m not even really sure what she was trying to ask but saying she was not sure what the witness is going to say. But then turned around and said but what she has to say is relevant and the judge looked at her with that judge looked at only a judge can give and said how do you know if you do not know what she’s going to say?
Now there’s an old saying in the courts and yet I think we’ve all seen it on TV it says never ask a question that you do not know the answer to in a court of law. It is a sound basic principle and you do not want to go on fishing expeditions in court. After it was all said and done the judge denied her line of questioning instructor testimony whatever was because the truth I don’t know I’m not sure what she was trying to get her to say.
Beverly Woody also stated that D Atwal had told her son had a good lawyer. Mme. DA asked her about Jack able a private investigator and stated she had not talked to him. Beverly Woody then said that she had talked to Steve Jacobson that Robert had owed money to Frank Carson for an appearance but Frank Carson apparently did not charge him. She wanted to keep saying that Robert felt bad about what it happens and she wanted to keep saying that her son went through hell. Missed what he continually tried to improviser comments and statements and testimony and really doesn’t have a clue about court decorum improper testimony.
It was also revealed that the Korey Kaufman family had received a letter sometime after he disappeared saying Corey had been beaten and killed in the DA was trying to show that Robin Woody wrote that letter on her deathbed. Defense attorneys were inquiring as the whereabouts of the letter a copy as it was not apparently in discovery and Mme. DA advised that it was in the possession of Turlock Police Department. So we have a letter that was written by someone who thinks they are in the know on what happened, sent it to the Kaufman family to tell them what happened, and the DA’s office does not have that letter in their possession in this preliminary hearing in this murder case.
Beverly Woody did say that when she was shown the letter during the investigation that she felt that it was in Robin’s handwriting even though it was not signed were dated. It must be also noted that the testimony that was being given as to the letter was objected to and the judge determined after listening to it that it would be stricken from the record.
For some reason Mme. DA decided to go back to some testimony that was given in the morning about the officer standing outside the building on Frank Carson’s property. Now Beverly Woody had trouble in the morning testimony, using at least two probably three different names for him and couldn’t identify him, and also stated he was a Turlock Police Department officer. Remember she said that he was the one that told Robert to go back into the building and clean up the mess after he was killed. When asked about it again Beverly’s Woody said it was Walter wells who was the officer outside the told him to go back in to clean up the mess. At this time, it was pretty obvious that Beverly Woody was a little confused she was pretty agitated and probably getting pretty tired.
She stated that Walter wells was at the ninth Street property and told Robert Woody to go back inside and he was in a squad car, and there’s a reason why I repeated that. At that point Walter wells attorney Tim Rein immediately and loudly objected to this line of questioning which is the third time is spent asked today and get the third different answer, this time pointing the finger at Walter wells. Mr. Rein insisted this line of questioning is prosecutor misconduct again in leading the witness and is a total disregard to the previous testimony this witness gave. He is also very insistent that somebody must to talk to Beverly Woody during the lunch hour for that change in testimony and something had to be discussed for the DA to go back and discuss that testimony again. It was not brought out through a line of questioning it was a question that was asked after changing the subject went directly talking about Walter wells, with the DA mentioning his name first.
Mme. DA needless to say as she usually does go ballistic, complaining okay it was whining about these accusations by defense attorneys and does not stop long enough to realize she given them all the ammunition they need. Mme. DA also felt the need to chastise people in the gallery saying that she has a rabbit ears up and can hear their comments.
All this arguing led to more arguing with Tim Rein in other attorneys to jumping in all at the same time including the Dist. Atty. it was not pretty, this is the first time I’ve ever seen a judge get up in the middle of a hearing and walkout. They then decided it was time to take a recess and I think that was a good choice.
Once the dust cleared, down and everybody return to court Tim Rein address the court stating he does not feel this is a search for justice and Mme. Dist. Atty. brought up this question about Walter Wells out of the blue and it was a leading question to the witness. He also states there is no good faith reason for that question especially since it had been covered twice before today. In addition, Walter wells has good witnesses discussing his whereabouts on that day where the DA does not appear to be taking that into account
Mme. DA responded by saying she feels that she does not have to justify her questions in addition does not feel that anybody can justify Walter wells as location at the time of this occurrence. The judge then commented very sternly stating she will decide who is credible and who is not.
Martha Magana went on record as saying that she feels this is perjured testimony by Barbara Woody as to the different and changing stories just like Robert and I felt the judge made a very interesting response to Ms. Magana saying all the witnesses are telling different stories and are inconsistent. That might be an indication of how this judge’s feeling about this case of these witnesses.
After the smoke it cleared, Barbara Woody was brought back into testify and says again the Walter wells was outside the property and the officer originally identified as Q or yu, was actually the one at the pop n cork. She repeated again that Frank Carson was the one that took the gun and does not know what happened to it after that. It was also brought out that Beverly Woody never told investigators namely Steve Jacobson this information had only said it to Robert Woody’s attorney stating she had held back the information from investigators. Finally, Mme. DA decided to rest on this direct.
Percy Martinez made an objection to no information was ever discovered to this last part of testimony and asked that all testimony in regard to that be stricken the motion was denied.
Tim Rein then began cross-examination of Beverly Woody and began talking about family members living in the house and their names, Ms. Woody seem to even have problems remembering in identifying each member of the family that it lived in that house. She had known Steve Jacobson since 2013 from this investigation. When it when she was asked when was Robert arrested she said it was right after Christmas sometime. She said she talked to Steve Jacobson for about an hour during a search of her house, the first one. As there were two that were done on that house.
During his questioning also she revealed in the past there have been visits with Robert at the DA’s office with them making special arrangements, and apparently there were several, with the last one being about a week ago. She stated that during these visits that she gets at the DA’s office other family members get to join in and there is an investigator in the room with them during these visits. Windows reported to the court last week that the special visits are being made, Mme. DA had submitted to the court that they were put in a room and left alone to visit, the were no recordings no interviews no documentation. But Beverly Woody stated during the visit last week that Steve Jacobson said in the room with them during the entire visit with another investigator standing outside the door.
Beverly Woody advised that there was a special arrangement made by the DA’s office as she is not able to travel to visit Robert at the present he is currently housed, and that is also kept confidential.
Beverly Woody was excuse for the day at that point as there was some general business to be taking care of at the end of the day, one of Robert Woody’s attorneys requested that no information about his current location be revealed through questioning by any the attorneys, this was done for Robert Woody’s safety. The attorneys began requesting any transcripts audio video of these visits and some of them could not guarantee the location could not become an issue as information developed.
Another file of discovery was received by the court today the judge had opened that it was in regards to a subpoena by Jesse Garcia and it was a Brian Woody files from Department of Corrections.
No further court activities occurred today, a lot of fireworks which I feel are going to continue on in this case.
Court continued until 930 tomorrow I hope to see my fan base there again tomorrow as I was completely satisfied with their appearance today even though it was extremely short.
