I finally returned from the dead today, and was able to attend the brief morning session of this preliminary hearing. I have been unable to attend for over a week, after coming down with pneumonia. I need to get my strength back, and plan to attend the entire day of testimony tomorrow. Prosecuting DA Marlissa Fereirra seemed to be like the same broken skipping record that I saw the last time I was in the courtroom a week ago. Marlissa’s line of questioning continues to go into irrelevant subjects that had Judge Zuniga asking her many times what she was trying to do. Marlissa tried to explain her reasons, but it was obvious that the judge has had enough of her misguided tactics. I guess she has already shot her best ammunition, and is left with only mindless little factoids of worthless testimony to support her failing case.

The day started out around 11:15 today, because the hearing was supposed to be done by now, and defense attorney Martha Carlton Magana had taken on another case. We had to wait for Martha to arrive before Frank Carson’s preliminary hearing could continue.

Defense attorney Robert Forkner announces to the court that Patrick Hampton had been arrested at the Chicken Ranch Casino for possession of methamphetamine, and sales of methamphetamine. Forkner requests that Judge Zuniga issue a preservation order to preserve any and all communications between Patrick Hampton and the District Attorney’s office after his arrest. He stated that Patrick Hampton has a “Get out of jail free card in Stanislaus County.” Patrick is being held in Tuolumne County, and I hope they keep this creep in custody for as long as legally possible. He simply can’t keep himself out of trouble, and is a danger to the general public. Marlissa Fereirra states that the DA’s office has had no contact with Patrick Hampton since his arrest. This is hard for me to believe. I am sure that his handler Steve Jacobson was up there talking to him immediately. DOWN SIMBA, DOWN.

Defense attorney Martha Carlton Magana starts out on cross examination of DA Investigator Steve Jacobson asking him questions concerning the fact that he joined the Carson Task Force at the same time that Frank Carson was suing him for assault, and prosecuting him for contempt of court for jury tampering. Martha attempted to show that Jacobson had a bias against Frank Carson while he supervised the wiretaps. It was brought out that Judge Steffen cited Jacobson for contempt of court for the jury tampering incident in the AJ Pontillo case. Judge Zuniga stated that these facts had been thoroughly brought out already in this preliminary. Marlissa Fereirra objected to this line of questioning for being beyond the scope of evidence. The objection was sustained. Martha Carlton Magana was not through arguing on this subject, but it goes nowhere.

Prosecuting DA Marlissa Fereirra tries to go into an alleged “Tazing Party” at Pop N Cork Liquors that was attended by the officers. Judge Zuniga quickly asks Marlissa what is the relevancy on this subject. She states that this is a preliminary hearing. The judge did not allow this line of questioning to continue.

Marlissa Fereirra then tries to go into whether Jacobson was familiar with the guns that were seized at Pop N Cork. This was objected to, and the objection was sustained.

Marlissa Fereirra then questions Jacobson about the interagency meetings concerning Frank Carson that were held in 2015. He was asked by one of the defense attorneys if Sheriff Adam Christiansen was present at these meetings. Jacobson said “Not to my recollection.” I don’t believe that is true. Jacobson said representatives from the California Department of Justice, Turlock Police Department, Stanislaus County DA’s office, Stanislaus County Sheriff’s Department, FBI, Ceres Police Department, and Modesto Police Department were present.

Steve Jacobson testified that an officer named Kevin Dombe from the California Highway Patrol was present, and that Department of Justice monitors were used in the Frank Carson wiretaps to avoid conflict of interest concerns.

It is now time for lunch, and we will not be starting up until around 2:00 PM at the earliest, because of defense attorney Martha Carlton Magana’s new court case. It seems like the faster we go, the behinder we get. I will be there for the entire day tomorrow, if my health permits.

Sincerely; William Thomas Jensen (Tom)
