  1. Some questions for this morning’s podcast.

    1- Can the judge tell the prosecution no 115 testimony because we the have witness right here available and it is against the “spirit of the law”. Can 115 used when the witness is readily available? Can the judge or defense request that 115 not be used when a key witness to the trial is available so we must put him on the stand and not circumvent the system by using 115? Is their legal precedent to let the judge decide if 115 testimony can be used?

    2- Can COG and SOM be used on witnesses? Especially SOM? In a prelim can the judge dismiss a witness, as she can with wire taps? Or does the defense just have to object constantly?

    3- I forget, but can you refresh our memories, as I am sure there are new people here every week too, and have been following forever, but how are Hampton and Romero relevant to this case? What information do they have related to this to this case? Also, SOM of these witnesses? Everyone knows they got sweet deals and what their SOM is.

    4- What is a Brady Issue?

    5- DA keeps taking wire taps out of context, and then she is going to put them into her own context that will show whatnot. But if you let me take a bunch of information out of context, and then put them into my own context, I can create almost any narrative I want? It is something a lot of questionable “preachers” do with the Bible.

    Hope that gives you some fodder for the show. They are serious questions I have though.
