KIRK BUNCH HAD TO ADMIT UNTRUE TESTIMONY

I expected today to be a short morning session with nothing of importance happening. Boy was I wrong. It was like a meat locker in the courtroom this morning. I was sitting there in my usual tie dye shirt freezing to death, and DA Investigator Kirk Bunch was sweating on the stand. The sweat was dripping down his face. They say rabbits only sweat through their nose. Oh well.

Defense attorney Martha Carlton Magana was continuing her cross examination of Kirk Bunch. She got into a line of questioning that flustered Bunch, and the sweat began to flow. Her questions were followed by questions by defense attorney Hans Hjertonnson that made Bunch look like he was sitting in a sauna. I will now try to give you some details of our short morning session.

Martha starts asking Kirk Bunch if he had shown Woodrow Woody a picture of Bobby Tickner. Bunch says: “No.” Martha then tells Bunch that Robert Woody had told his son that he was on the “The Lawyer’s” property with Robin Attenhoffer. She then says that Robert Woody had said that he was on a big lot, but did not say which big lot he was on. Martha then states that Robert Woody had told his son he did not see what property he was on. Martha says that in August 2015 Robin Attenhoffer told Woodrow Woody that she was present on the property when Korey Kauffman allegedly was killed. Later on Robert Woody said she was not present on the property.

Martha then says that evidence shows that in August 2015 Woodrow Woody had said that his father made no mention of gun shots on the property when he talked to Woodrow. Martha begins talking about a March 2015 phone call from Bunch to Woodrow Woody. Bunch begins to sweat on the stand. Martha asks Bunch if he has evidence that on 03/30/2012 that Robert Woody was not on the Carson property, but was actually in Washington State. Martha talks about a Western Union wire transfer sent to Washington where money was sent to Robert Woody.

It seems as though Detective Dale Lingerfeldt had uncovered this evidence


Martha asks Bunch if it is true that he told Woodrow Woody that he was facing life in prison unless he cooperated with the DA. Bunch said that he had said that to Woodrow. More sweat was flowing from Kirk Bunch.

Martha Carlton-Magana then asks Bunch if he had spoken to Jason Armstrong and Gary Crosby during the six-week period before he had interviewed Woodrow Woody. Bunch said that he did speak to these two people during this period of time. Martha tells Bunch that he knew Jason Armstrong knew where Korey Kauffman’s burial site was located in the mountains, and that he had taken people to that site six weeks before he spoke to Woodrow Woody.

Martha then states that Kevin Pickett had spoken with Jason Armstrong at Pop N Cork Liquor about the grave site.

Martha Carlton-Magana then talks about a 22 Cal Rifle that was taken in the search warrants that was tested, and tested negative for the one that allegedly was involved with the killing of Korey Kauffman. Martha is now done with a sweating Kirk Bunch.


Defense attorney Hans Hjertonnson then takes over on cross examination. Hans talks about the 3 generations of Robert Woodies that all were living together. It seems like that TV skit where we have Daryl, and his brother Daryl, and his father Daryl happening in the real world.

Hans Hjertonnson then starts talking about the arrangement where Bunch and Jacobson would drive Robert Woody back and forth from his undisclosed jail to Modesto. This drive was approximately one hour in each direction. Bunch tells Hans that he does not recall the dates when he and Jacobson drove Woody back and forth from the undisclosed jail location. Kirk Bunch once again states that he did not record any of these times where they would have been obviously talking. Bunch denied that they had stopped for food.

Hans Hjertonnson then talks about an interview that he had done with Brian Woody. Hans zeroes in on the interview tactics that Kirk Bunch seems to utilize so very often. Hans tells Bunch that he had no information concerning the disappearance of Korey Kauffman. Hans then reminds Bunch that on a second interview Brian Woody had told Bunch that he had no information on Korey Kauffman as well.

Hans then tells Bunch that during testimony on Monday that Bunch had not disclosed that Brian Woody had denied having any knowledge about Korey Kauffman. Hans stated that Bunch had testified on Monday that Brian Woody had told him that Baljit Athwal was “Doing Security” on the Carson property. Hans states that when Marlisa Ferreira asked him on 08/01/2016 about who was doing security on the Carson property he had testified that Brian Woody had said that Baljit Athwal was doing security on the Carson property.

Kirk Bunch is dripping sweat on the stand. He states that he does not recall saying that on the stand. He is shown his testimony from Monday, and takes about 5 minutes to read it. When asked again by Hans Hjertonsson if he had said that Brian Woody had said that Baljit Athwal was doing security, Bunch admitted that he had said that on the stand. Bunch looked destroyed on the stand at this time. Bunch admits that his testimony was “Incorrect” about Robert Woody, Daljit Atwal, and Baljit Athwal being on the Carson property that night. This seems to be HUGE to me. Incorrect seems like a lie to me. This preliminary hearing is peppered with such lies.

Hans Hjertonnson asks Bunch if Woodrow Woody told him that his dad was in Washington State at the time that Korey Kauffman was allegedly killed on the Carson property. Bunch says “Yes.”

Kirk Bunch says he “Doesn’t Remember” when asked if Robert Woody’s stepfather was bragging about murdering Korey Kauffman. There was some talk about Kirk Bunch making a recording of this, but Bunch stated that he had never made a written report on this. Bunch testifies that he had never investigated who had told that to Robert Woody. It must have not fit his theory on this case. Just saying folks.

Hans Hjertonsson talks about how the stepmother had told Woodrow Woody things about the alleged murder, and had fed him information that he testified to on later interviews.


Marlisa Ferreira then tries to rehabilitate her destroyed investigator. I guess this is like putting lipstick on a rabbit. She gets Bunch to testify that they had information that contradicted Woodrow Woody’s claim that his dad was in Washington State on 03/30/2012. She states that Candy Watt had said that Robert Woody was not in Washington State. She states that Robin Attenhoffer stated that Robert Woody was not in Washington State. She states that the prosecution has proof that someone went to IN Shape Gym in Turlock on 03/30/2012 using a card registered to Robert Woody. People share these cards all the time. I am sure one membership serves much of the Woody family. That is the way that family seems to work. Togetherness. It is so sweet.

Martha gets back into action with Bunch. She starts talking about a person named David McMillan. She talks about Bunch interviewing Gary Crosby in late 2013 at Crosby’s house. Bunch states that Crosby met Jason Armstrong and David McMillan at a camp site during a hunting trip. This camp site was approximately 150 to 200 yards from the spot where Korey Kauffman’s remains were found. Crosby said that he noticed that another trailer was parked next to his trailer at the camp site in the Stanislaus National Forest. The two people told Crosby that they were from the Turlock/Denair area. Crosby told Bunch that he had told the two people about finding the body, and had pointed out the general area the body was located at.

Percy Martinez asks Bunch if Kevin Pickett had ever told him that he suspected Michael Cooley was involved in the killing of Korey Kauffman. Bunch says: “No.”

Martha Carlton-Magana reminds Bunch that Gary Crosby had told him that Armstrong and McMillan had called Korey Kauffman a thief, and had told Crosby that the campsite was their campsite that they have been using for years. This was said after Crosby had shown them the grave site location. They had asked Crosby to move his campsite. Bunch admits that was said to him by Crosby.


When asked if he had ever obtained a search warrant for Jason Armstrong, Bunch said: “No” When asked if he had ever obtained a wiretap of Jason Armstrong, Bunch said: “No.” It is brought out that Jason Armstrong is a friend of Kevin Pickett. His wife was living in a trailer in the back of the Pickett residence in Turlock.

It is brought out that Jason Armstrong bought stolen tools that had been stolen from a tire shop. He bought them from Kevin Pickett. Korey Kauffman had possession of these stolen tools. Jason Armstrong had threatened Korey Kauffman with bad things if he didn’t get these stolen tools back. It is brought out that Korey Kauffman was afraid of Jason Armstrong.

Bunch is asked if he saw a picture of Jason Armstrong on the game cam that was placed at the grave site. Bunch says: “Yes.”

We have run out of time for the morning session, and there is no afternoon session today. The defense attorneys have some evidence to go through this afternoon. Monday, we should finally get around to the testimony of Robert Woody. It will take a very long time.

One of those days it does not paid to get out of bed

Just for clarification on Robert Woody’s plea yesterday, many people believe that he got 12 years four months that is not correct. This plea agreement is for seven years four months, he gets a strike for the voluntary manslaughter, he gets a strike for the arson. He has no previous strikes so those are only two strikes on his record.

Now the 12 years four months he will get if he does not complete the conditions of his agreement. So if he does not testify to as agreed he will then get the 12 years four months. If he does testify to what he agreed to he will get seven years four months which he will do about half time on, so 44 months and is probably in the area of 26 2728 months now. So he has an additional 15-16 months or so before getting released, and he will probably do that locally in the county jail but as a department of corrections inmate.

Now back to the preliminary hearing which we just had abbreviated day, and only a morning session.

Kirk Bunch took the stand again to prop 115 Robert Lee Woodrow Junior, also known as Woodrow. He stated that he never showed Woodrow a picture of Bobby Ticknor. And when he talked to Woodrow he stated it was Robin Attenhoffer who had told him about the incident on Carson’s property that night.

Robin said she was at the scene and had seen a beating going on. This is an interview done in August 2015 and about the third story he had told. And in the previous stories there was no mention of gunshots as was told in the August of 2015 interview.

Martha Magana approached the witness on the stand with a document which has to be copied for all to see, and she says it is summary of look phone call between Kirk bunch and Woodrow. Woodrow had told Kirk bunch that Robert Woody was in Washington at the time of the incident and Kirk bunch admitted he never personally confirmed the information whether he was or not, but there were some checks made by other investigators as far as money transfers or anything of the like.

He was asked about Jason Armstrong knowing where the site was where the Korey remains were found. He admitted that Jason Armstrong and another gentleman had talked to the Hunter that had real originally found the body. And the other gentleman who name escapes me right now, was caught on again can that they had put up there at the scene. In addition, that Kevin Pickett was at pop and Cork on at least one occasion when Jason Armstrong was talking about where the school was located.

Attorney Hans asked investigator bunch about transporting Robert Woody from the out of county location that he was in, which we all know was Tuolumne, and if any documentation was made on those transports. He also said they never stopped anywhere along the way after his court dates for food drinks or anything else.

He was asked if it is the DA investigators function to transport inmates to and from court, and he stated that he had contacted the Sheriff Department transport and they would not do the transport so they were had to do them themselves. Now being extremely familiar with transports was from the custody division in the past that is exactly what their function is that the transport to and from court appearances even out a County. Now he may have had to come a day or two earlier and go back a day or two later and that might’ve inconvenienced Tim so they didn’t want to do that. But they have a bus that runs a regular route to all the jails and prisons to pick up inmate for such occasions.

Kurt bunch is also asked if he ever used any one particular tactic for interviewing and talking to people and getting information, and he stated that each situation is a unique to itself and that each is different at all need to be handled different. Kirk bunch was asked about some testimony he made on Monday as for the people on the property and he had to admit after reading the testimony he had stated it incorrectly.


He was also asked if he had generated a report for this conversation on the phone Woodrow and instead he did not because it was recorded. I also noted that this time to Kirk bunch was looking a little red and getting a little Pissy on the stand. In addition, Woodrow stated during our phone call that there may have been other people in the family that may have been responsible for the Korey’s death.

The Dist. Atty. then started redirect and he said that Woodrow was more cooperative in this conversation he had been in the past I was trying to reveal more information about Robert Woody and being in Washington at the time. He had also talked to Kandi Watts, Robert Woody’s former girlfriend and the mother of his kids, but he did say that he was able to establish that Robert Woody was at in shape city on three 3-30-2012, working out.

This line of questioning was objected to by Mark Martha Magana very loudly very vigorously as she stated it was misrepresenting the evidence, and the representations the DA was making to the court. Percy Martinez concurred with that objection which was overruled.

Percy Martinez asked if Kevin Pickett at ever said that Michael Cooley was involved, which Kurt bunch denied, and again cams were installed in late 2013.

Martha Magana start another re-cross and asked if the Hunter Crosby and had a dispute with Jason Armstrong and David McMillan over with Jason Armstrong thought was the Hunter was using their campsite to do been using for years. He also said that there was no investigation of Jason Armstrong and the issue of his stolen tools allegedly taken by Korey Kauffman and finally found at the Michael Cooley house. Michael Cooley apparently want to give the tools back but had extreme fear of Jason Armstrong.

During this line of questioning there was multiple objections by the Dist. Atty. Martha Magana was trying to get another bit of information out of Kurt bunch on the stand, as she was not able to get the question out properly to be allowed to ask, and it’d been just a little past the noon hour the judge said were going to have to come back at 130 Martha Magana said she’s not making everybody coming back to 130 for one question.

So at that time we broke for the day which is just about five minutes after 12 and we are back in court Monday morning 10 AM and probably taken testimony from Robert Woody.
