KIRK BUNCH HAD TO ADMIT UNTRUE TESTIMONY
IT’S WHAT I CALL A LIE
FRANK CARSON CASE

I expected today to be a short morning session with nothing of importance happening. Boy was I wrong. It was like a meat locker in the courtroom this morning. I was sitting there in my usual tie dye shirt freezing to death, and DA Investigator Kirk Bunch was sweating on the stand. The sweat was dripping down his face. They say rabbits only sweat through their nose. Oh well.
Defense attorney Martha Carlton Magana was continuing her cross examination of Kirk Bunch. She got into a line of questioning that flustered Bunch, and the sweat began to flow. Her questions were followed by questions by defense attorney Hans Hjertonnson that made Bunch look like he was sitting in a sauna. I will now try to give you some details of our short morning session.
Martha starts asking Kirk Bunch if he had shown Woodrow Woody a picture of Bobby Tickner. Bunch says: “No.” Martha then tells Bunch that Robert Woody had told his son that he was on the “The Lawyer’s” property with Robin Attenhoffer. She then says that Robert Woody had said that he was on a big lot, but did not say which big lot he was on. Martha then states that Robert Woody had told his son he did not see what property he was on. Martha says that in August 2015 Robin Attenhoffer told Woodrow Woody that she was present on the property when Korey Kauffman allegedly was killed. Later on Robert Woody said she was not present on the property.
Martha then says that evidence shows that in August 2015 Woodrow Woody had said that his father made no mention of gun shots on the property when he talked to Woodrow. Martha begins talking about a March 2015 phone call from Bunch to Woodrow Woody. Bunch begins to sweat on the stand. Martha asks Bunch if he has evidence that on 03/30/2012 that Robert Woody was not on the Carson property, but was actually in Washington State. Martha talks about a Western Union wire transfer sent to Washington where money was sent to Robert Woody.
It seems as though Detective Dale Lingerfeldt had uncovered this evidence
Martha asks Bunch if it is true that he told Woodrow Woody that he was facing life in prison unless he cooperated with the DA. Bunch said that he had said that to Woodrow. More sweat was flowing from Kirk Bunch.
Martha Carlton-Magana then asks Bunch if he had spoken to Jason Armstrong and Gary Crosby during the six-week period before he had interviewed Woodrow Woody. Bunch said that he did speak to these two people during this period of time. Martha tells Bunch that he knew Jason Armstrong knew where Korey Kauffman’s burial site was located in the mountains, and that he had taken people to that site six weeks before he spoke to Woodrow Woody.
Martha then states that Kevin Pickett had spoken with Jason Armstrong at Pop N Cork Liquor about the grave site.
Martha Carlton-Magana then talks about a 22 Cal Rifle that was taken in the search warrants that was tested, and tested negative for the one that allegedly was involved with the killing of Korey Kauffman. Martha is now done with a sweating Kirk Bunch.
Defense attorney Hans Hjertonnson then takes over on cross examination. Hans talks about the 3 generations of Robert Woodies that all were living together. It seems like that TV skit where we have Daryl, and his brother Daryl, and his father Daryl happening in the real world.
Hans Hjertonnson then starts talking about the arrangement where Bunch and Jacobson would drive Robert Woody back and forth from his undisclosed jail to Modesto. This drive was approximately one hour in each direction. Bunch tells Hans that he does not recall the dates when he and Jacobson drove Woody back and forth from the undisclosed jail location. Kirk Bunch once again states that he did not record any of these times where they would have been obviously talking. Bunch denied that they had stopped for food.
Hans Hjertonnson then talks about an interview that he had done with Brian Woody. Hans zeroes in on the interview tactics that Kirk Bunch seems to utilize so very often. Hans tells Bunch that he had no information concerning the disappearance of Korey Kauffman. Hans then reminds Bunch that on a second interview Brian Woody had told Bunch that he had no information on Korey Kauffman as well.
Hans then tells Bunch that during testimony on Monday that Bunch had not disclosed that Brian Woody had denied having any knowledge about Korey Kauffman. Hans stated that Bunch had testified on Monday that Brian Woody had told him that Baljit Athwal was “Doing Security” on the Carson property. Hans states that when Marlisa Ferreira asked him on 08/01/2016 about who was doing security on the Carson property he had testified that Brian Woody had said that Baljit Athwal was doing security on the Carson property.
Kirk Bunch is dripping sweat on the stand. He states that he does not recall saying that on the stand. He is shown his testimony from Monday, and takes about 5 minutes to read it. When asked again by Hans Hjertonsson if he had said that Brian Woody had said that Baljit Athwal was doing security, Bunch admitted that he had said that on the stand. Bunch looked destroyed on the stand at this time. Bunch admits that his testimony was “Incorrect” about Robert Woody, Daljit Atwal, and Baljit Athwal being on the Carson property that night. This seems to be HUGE to me. Incorrect seems like a lie to me. This preliminary hearing is peppered with such lies.
Hans Hjertonnson asks Bunch if Woodrow Woody told him that his dad was in Washington State at the time that Korey Kauffman was allegedly killed on the Carson property. Bunch says “Yes.”
Kirk Bunch says he “Doesn’t Remember” when asked if Robert Woody’s stepfather was bragging about murdering Korey Kauffman. There was some talk about Kirk Bunch making a recording of this, but Bunch stated that he had never made a written report on this. Bunch testifies that he had never investigated who had told that to Robert Woody. It must have not fit his theory on this case. Just saying folks.
Hans Hjertonsson talks about how the stepmother had told Woodrow Woody things about the alleged murder, and had fed him information that he testified to on later interviews.
Marlisa Ferreira then tries to rehabilitate her destroyed investigator. I guess this is like putting lipstick on a rabbit. She gets Bunch to testify that they had information that contradicted Woodrow Woody’s claim that his dad was in Washington State on 03/30/2012. She states that Candy Watt had said that Robert Woody was not in Washington State. She states that Robin Attenhoffer stated that Robert Woody was not in Washington State. She states that the prosecution has proof that someone went to IN Shape Gym in Turlock on 03/30/2012 using a card registered to Robert Woody. People share these cards all the time. I am sure one membership serves much of the Woody family. That is the way that family seems to work. Togetherness. It is so sweet.
Martha gets back into action with Bunch. She starts talking about a person named David McMillan. She talks about Bunch interviewing Gary Crosby in late 2013 at Crosby’s house. Bunch states that Crosby met Jason Armstrong and David McMillan at a camp site during a hunting trip. This camp site was approximately 150 to 200 yards from the spot where Korey Kauffman’s remains were found. Crosby said that he noticed that another trailer was parked next to his trailer at the camp site in the Stanislaus National Forest. The two people told Crosby that they were from the Turlock/Denair area. Crosby told Bunch that he had told the two people about finding the body, and had pointed out the general area the body was located at.
Percy Martinez asks Bunch if Kevin Pickett had ever told him that he suspected Michael Cooley was involved in the killing of Korey Kauffman. Bunch says: “No.”
Martha Carlton-Magana reminds Bunch that Gary Crosby had told him that Armstrong and McMillan had called Korey Kauffman a thief, and had told Crosby that the campsite was their campsite that they have been using for years. This was said after Crosby had shown them the grave site location. They had asked Crosby to move his campsite. Bunch admits that was said to him by Crosby.
When asked if he had ever obtained a search warrant for Jason Armstrong, Bunch said: “No” When asked if he had ever obtained a wiretap of Jason Armstrong, Bunch said: “No.” It is brought out that Jason Armstrong is a friend of Kevin Pickett. His wife was living in a trailer in the back of the Pickett residence in Turlock.
It is brought out that Jason Armstrong bought stolen tools that had been stolen from a tire shop. He bought them from Kevin Pickett. Korey Kauffman had possession of these stolen tools. Jason Armstrong had threatened Korey Kauffman with bad things if he didn’t get these stolen tools back. It is brought out that Korey Kauffman was afraid of Jason Armstrong.
Bunch is asked if he saw a picture of Jason Armstrong on the game cam that was placed at the grave site. Bunch says: “Yes.”
We have run out of time for the morning session, and there is no afternoon session today. The defense attorneys have some evidence to go through this afternoon. Monday, we should finally get around to the testimony of Robert Woody. It will take a very long time.
