JUDGE ZUNIGA CONTINUES TO BE LATE
FRANK CARSON CASE

I returned to the courtroom today after a week away, and nothing has changed. Court was supposed to start at 9:30AM, but Judge Zuniga showed up 22 minutes late. Honestly, I can’t remember the last time she has shown up on time. We are within 2 days of an entire year having come and gone in this preliminary hearing. This judge is responsible for a good portion of this time. Meanwhile, Frank Carson, Walter Wells, Daljit Atwal, and Baljit Athwal remain incarcerated for alleged crimes that they have not even been charged for.
We are finally allowed to enter the courtroom at 10:15AM, and Marlisa Ferreira speaks about more discovery that she has just turned over to the defense. A year of testimony, and she is just now turning over discovery that should have been provided at the beginning of this preliminary hearing. This has had a great impact on the defense being able to defend their clients. Marlisa speaks about information that has been obtained from lap top computers that were seized during the search warrants. She says there are around 130 separate items. Marlisa then talks about discovery concerning some Robert Woody audio tapes that she has just now turned over. The cross examination of Robert Woody has been going on for around six weeks, and this information would have allowed the defense attorneys to explore things with Woody that they did not even know about. How can this be a fair preliminary hearing?
Defense attorney Martha Carlton-Magana announces that she wants to play the entire 7 hours and 18-minute video recording of Robert Woody’s first interview that was done on 03/01/2014 at the Stanislaus County DA’s Office. This was done on the night of his arrest for the murder of Korey Kauffman. There seems to be some disagreement between the defense attorneys regarding the playing of this video recording. Marlisa Ferreira also states that she does not want the video to be played. Defense attorney Timothy Rien, and defense attorney Jesse Garcia object to the video recording being played.
Defense attorney Martha Carlton-Magana wants the video recording to be played to show how extensively Robert Woody was coerced into saying what the investigators wanted him to say. Judge Zuniga states that this coercion is a key element of the defense attorney’s arguments, and she will allow the recording to be played.
Robert Woody is put on the stand, and taken off the stand several times before we finally begin playing the video recording at 11:15AM.
Present in the interview room were DA Investigators Steve Jacobson and Kirk Bunch, Detective Jon Evers, and Robert Woody. Woody was wearing a black hoody sweat shirt. Right off the start, Jacobson is talking to Woody about how the people he was involved with are threats to his safety. Jacobson: “These people have tentacles that can reach many places.” Jacobson: “Those guys think they are untouchable, they said you had something to do with Robin Attenhoffer passing away.” Jacobson: “You done really good, you chopped off your hair, and got clean so you could pass random drug tests.” Jacobson then says he is going to go get pizza and burritos for everyone, and leaves the room.
At this time, DA Investigator Kirk Bunch and Detective Jon Evers come into the room with Woody. Bunch asks Woody what his date of birth is, and Woody says 07/05/1975. Bunch talks to Woody about November 2011 when he was arrested for possession of stolen property. Woody says that he talked to Frank Carson after his arrest, and that Daljit Atwal had driven him to court where he spoke to Frank Carson. Bunch asks Woody what was said concerning Frank Carson’s stolen properties, and shows Woody a picture of Frank Carson. Woody does not seem to recognize the picture, and Bunch tells Woody that this is a picture of Frank Carson. Woody is shown a picture of Korey Kauffman, and does not recognize the person in the picture. Bunch: “We are trying to do all we can to help you.” Bunch: “Your Mom says you were there, I heard it and everything on a recording.” Bunch: “Were you there?” Woody: “No.” Bunch: “Has someone gotten to you?” Bunch then tells Woody that Korey Kauffman was killed on 03/30/2012. Bunch: “Is there no way we can change your mind?”
Bunch then shows Woody pictures of Baljit Athwal and Daljit Atwal. Bunch: “These guys are going to throw you under the bus.” Bunch: “Frank Carson is going to say that you killed Korey Kauffman.”
Bunch then tells Woody that his cousin was present at Pop N Cork when Baljit and Daljit had a conversation with Woody about going after Korey Kauffman for stealing property from Frank Carson. Bunch tells Woody that his cousin had spoken to himself and Detective Jon Evers 3 days ago concerning this conversation at Pop N Cork. Bunch: “I don’t believe you did this by yourself.” Bunch: “Your Mom swore up and down you are going to do the right thing.” Bunch makes some remark about how he believes everything that Beverly Woody is saying is the truth. The truth and Beverly Woody do not exist in the same universe.
Bunch tells Woody that witness statements put three people at the killing of Korey Kauffman, and that they were lying in wait. Bunch tells Woody that this qualifies for special circumstances which would allow the death penalty to be used. Bunch: “They are all going to be pointing their fingers at you.” Woody still denies that he was present at the killing of Korey Kauffman. It is now time for our lunchtime break.
I will not be there for the afternoon session today, and have a doctor’s appointment tomorrow morning. I intend on reporting on the afternoon session tomorrow.
