It is going to be fun writing today’s article. We had Michael Cooley on the stand once again, and he was utterly destroyed on the stand by defense attorney Percy Martinez. Now sit back and let me paint a picture for you of what I witnessed in the courtroom.

At 9:10AM, the jury is brought into the courtroom, followed by prosecution witness Michael Cooley. Marlisa Ferreira continues with her direct examination of Cooley on the stand. She tells Cooley that she wants to take him back to the night that Korey Kauffman disappeared. Michael Cooley states that he knows Detective David Shaw of the Turlock Police Department. He states that Detective Shaw had helped him with some false allegations against him that were made by another officer, and considers him to be a friend. Cooley states that Eula Keyes called Detective Shaw the day after Korey Kauffman had gone missing, and that Detective Shaw came over to their house the next day. We now had a side bar. Marlisa Ferreira asks Cooley if he told Detective Shaw all the information that he had concerning Korey Kauffman. Michael Cooley states that he had told Shaw everything. Cooley testifies that he did not tell Detective Shaw anything about the pipes being set out on the Carson property. Michael Cooley states that Korey Kauffman had told him that he was going around the corner, and would be back soon. Cooley states that he told Detective Shaw a description of what Korey Kauffman had been wearing. Cooley states that Detective Shaw told him that he was going to help him. Michael Cooley states that he only spoke with Detective Shaw once. Cooley testifies that he met with DA Investigator Kirk Bunch the next day. This answer apparently did not sit well with Marlisa Ferreira, and she tries to refresh his memory. Michael Cooley states that he was not refreshed by the material she had him read. Michael Cooley states that he told Kirk Bunch everything that he knew concerning Korey Kauffman. He states that he told Kirk Bunch about the pipes being set out on the Carson property.

Marlisa Ferreira asks Michael Cooley about how he felt about Korey Kauffman. Cooley states that Korey Kauffman was his best friend, and that he misses him a lot. Cooley states that he never had a knife fight with Korey Kauffman and denies having a knife fight with Ronald Cooper. He admits to flashing a knife at Ronald Cooper. Michael Cooley denies being jealous over Eula Keyes. Michael Cooley denies killing Korey Kauffman. It seems as though meth and heroin has made his nose grow. Cooley states that he kept Korey Kauffman’s bike for around ten months, and then buried it in the back yard. He states that he buried the bike so that nobody else would get the bike. A true scrapper like Michael Cooley with multiple drug addictions would have cut the bike up and sold it for scrap. Marlisa Ferreira is now done with her direct examination.

Percy Martinez takes over on re-direct examination of Michael Cooley. Percy Martinez: “You killed Korey Kauffman didn’t you?” Michael Cooley: “No, didn’t you kill him?” Michael Cooley denies using meth or heroin in the 24 hours leading up to the disappearance of Korey Kauffman. He states that he has been clean for the last three months, and is enrolled in a program called Genesis. He states that he used heroin every other day for 20 years. I bet he was a bastard on the days in between. He states that he was using meth and heroin every other day in 2012, but not on the day that Korey Kauffman went missing. He states that he used about a half a gram of each drug every other day.

Percy Martinez goes over Cooley’s extensive criminal background. This includes a burglary in Monterey County in 1990, a firearm conviction in November of 1996, a petty theft conviction in Monterey County, a 1998 petty theft conviction in Stanislaus County, and a 2009 burglary conviction in Stanislaus County. Michael Cooley admits on the stand that he told Marlisa Ferreira that he was going to refuse to answer any more questions that last time he was at the courthouse to testify. He denies that he was threatened with arrest and other consequences after saying this. Cooley denies getting any benefits for his testimony.

Michael Cooley is asked by Percy Martinez why he has a lawyer in the courtroom today. He states that he is on probation for a possession for sales of meth that happened three years ago. He states that he spent four months in the county jail for this conviction, and was able to get off with a misdemeanor. Cooley states that he told the truth to Detective Shaw. He denies being a snitch or an informant for Detective Shaw. He states that he likes Detective Shaw, and that Shaw is a cop that he trusts. He states that he has known Shaw for 10 years, and feels comfortable with him. He denies providing any information to Shaw in 2011.

Michael Cooley testifies that he told the police that he did not steal items from the Carson property, and had them search his house at least three times. He denies taking items from the Carson property for himself or for Eula Keyes. He denies telling Kirk Bunch that he had stolen items from the Carson property, even though written reports from Bunch confirm that he had told him this. Cooley states that he did not tell Detective Shaw about the accusations of theft that were made against him by Frank Carson. Cooley states that he told Detective Shaw about his problems with Frank Carson in 2012.


Michael Cooley testifies that he saw Korey Kauffman around 4 PM on the day that he allegedly went missing. He states that he and three other people were playing horse shoes. Ricky Cooley and Frank Fagundez were playing horse shoes with him. He states that they played horse shoes for around one hour, and did not see any people patrolling the Carson property on the other side of the fence at that time. He states that he saw pipes set up in a pile shaped like a pyramid about five feet from the fence line and about 40-50 feet from the hole in the fence. He states that there were 15-20 pipes, and they were stacked up about five feet high. He states that the pipes were around five feet long, and were made of aluminum. He states that they had planned on going over to the Carson property and throwing them over the fence.

Michael Cooley testifies that the hole in the fence was 4 feet high and 3 feet wide. Cooley now states that he went through the hole about 7 months before Korey Kauffman went missing to steal items, but that he had not seen anybody else go through the hole in the fence. He now states that this happened about one year before Korey Kauffman went missing. Cooley states that Frank Carson came over to his house to complain about the thefts about five months before Korey Kauffman went missing. He states that Frank Carson came over to his house around November of 2011, and told him that he was stealing from the Carson property again. Now Cooley states that he saw 4-5 people going through the hole in the fence about twice a month stealing from the Carson property. Cooley testifies that he tried to fix the hole in the fence using a piece of rope to tie it together. He states that he tried to fix the hole around the end of December, 2011. Cooley states that he had a verbal altercation with Frank Carson, and let him search his house. Cooley states that the Sheriff and Turlock Police Department showed up, and that Frank Carson said that he was someone else. Cooley denies that Frank Carson identified himself during that incident. That conflicts with what the police reports say happened. Cooley states that he told the police that Frank Carson told him that if he was caught stealing from the Carson property he would disappear and would never be seen again.

Cooley testifies that the first time he saw Frank Carson, Frank was parked across the street, and walked across the street to his property. Cooley states that he then went back into his house, and went back out after the cops showed up. He states that he told the police that Frank Carson had threatened him, but that he did not see any weapons. Cooley testifies that he did not see Frank Carson on the night that Korey Kauffman went missing.

Michael Cooley testifies that Frank Carson identified himself on the occasion where he was seen going through Linda Sue Burns’ car. He states that he would take stolen items from the Carson property to Linda Sue Burns’ house in Keyes where they were turned over to an antiques dealer by the name of Mark Kehoe. He denies that these items came from containers that had been broken into. He states that these items included lamps, signs, small tables, old furniture, etc. Frank Carson would have been storing these sort of items in the containers, and would have not left them on the ground exposed to the weather. Cooley now states that people would go back and forth all night long going through the hole in his fence to steal items from the Carson property. He states that this action would start as soon as it was dark, and would continue all night until the sun came up. Cooley states that he would be alerted to this because the Carson’s had three German Shepard dogs that would bark. He said that the dogs were friendly. Cooley states that the dogs were not barking on the night that Korey Kauffman went missing.

Michael Cooley testifies that he discussed stealing the pipes with Korey Kauffman on the night that he went missing. He testifies that it was getting dark on the night that Korey Kauffman went missing when he saw three people on the Carson property around 7:00PM. He states that they were playing horse shoes for about one hour, and Korey Kauffman left for home around 5:00PM. He states that he did not see any people on the Carson property at that time. Cooley states that when he did see people on the Carson property, one of the people had a long stick or a rifle in his hand. He testifies that the three people never walked away from each other. He states that they were standing about 10 feet from the pipes, and that he looked “Real quick” through some binoculars at them, but did not look through the binoculars at 7:00PM. Cooley states that Korey Kauffman came to their house around that time, and that Eula Keyes and Linda Sue Burns were there. Cooley could not remember if Linda Sue Burns went to Bingo that night as she has testified. Cooley states that Korey Kauffman stated that he was going to go to the feed mills down the street when he left. Cooley testifies that Korey Kauffman had come over to the house around 4:00PM in his dad’s primer grey truck, and parked in the driveway. He states that the truck was parked in his driveway all afternoon. Cooley states that Korey Kauffman came over on his bike the second time he showed up at the Cooley house. He described the bike as being a red mountain bike, and not a Sting Ray type bike. Cooley testified that he could see the bike from his front door. Percy Martinez shows how it is impossible to see the bike from the front door by showing a picture of the Cooley house. Michael Cooley denies that Korey Kauffman ever put the bike on the lawn that day.

Michael Cooley states that Korey Kauffman stayed around 30 minutes, and said that he was going around the corner, and to not let anybody mess with his bike while he was gone. He states that he did not tell Detective Shaw about this. Cooley states that he told Kirk Bunch Korey Kauffman had no tools with him when he left. Cooley testifies that Korey Kauffman had a big bandage on one of his hands, but could use his hand “Pretty good.” Cooley states that they moved Korey Kauffman’s bike to the side of their house on the left side by a business next door. Cooley states that Korey Kauffman took off on foot to Lander Ave around 8:00PM-8:30PM. He was not sure what direction Korey Kauffman took off to when he got to Lander Rd.

Cooley testifies that he did not leave the house or go out scrapping the night that Korey Kauffman went missing. He states that he did not do any meth or heroin that night. He states that he is not sure if Linda Sue Burns was there. Cooley states that he stayed up around two hours, and went to bed around 11:00PM. He states that he did not hear any barking dogs. He states that he did not hear any gun shots or screaming. Cooley testifies that the bike was on the side of the house the next morning. Cooley testifies that the bike did not have flat tires. This is a direct contradiction of previous testimony by Eula Keyes. Cooley testifies that a Crescent wrench was next to the bike the next morning. Cooley testifies that Eula Keyes called Detective Shaw the next morning. Cooley says Detective Shaw was told about the pipes. Cooley testifies that 6-7 of the pipes were missing the next morning, and that the pipe stack was only 3 feet high in the morning. He states that he pointed this out to Detective Shaw. Cooley denies that Frank Carson had ever fixed the hole in the fence. This contradicts earlier testimony.

Michael Cooley testifies that the feed mill was three blocks down Lander Ave to the right from the Cooley house. Cooley testifies that Korey Kauffman swore to him that he was not going over to the Carson property to get the pipes. Cooley denies removing the seat from Korey Kauffman’s bike, and says that he does not know what happened to this seat. This contradicts Eula Keyes’ testimony where she testified that she took the seat off to use on her own bike. Michael Cooley denies that the seat was put on Eula Keyes’ bike.

Percy Martinez now goes into a 04/28/2012 interview of Cooley by Kirk Bunch where Eula Keyes was present. After being refreshed, Cooley admits that he told Kirk Bunch that he stole copper about 4-5 months before Korey Kauffman had gone missing. Cooley admits that he had told Kirk Bunch that it was Frank Carson’s brother Terry who had told him that if he caught him stealing from the Carson property he would shoot him on sight, and his body would never be found. It is now time for our morning break.

After the break, Percy Martinez gets Cooley to admit that Frank Carson had not said that he was a private investigator the first time he was caught going through Linda Sue Burns’ car. Percy kept going through the 4/28/12 written report by Kirk Bunch, and Cooley could not remember saying what he said. He admits that Frank Carson gave his proper I.D. Now he says that he did not say that Frank Carson gave his proper I.D. He is getting angry and flustered on the stand. Cooley states that the police went to the rear of the barn on that occasion. Cooley states that a hole in the fence was present when the police came over on that occasion. Cooley states that the police noticed a path from the hole in his fence through the Cooley property. The path went to a wooden gate on the Cooley property.

Cooley once again admits that he told Kirk Bunch it was Terry Carson who had looked through Linda Sue Burns’ car. Cooley testifies that he told Eula Keyes that he was going to get the pipes from the Carson property to pay for tags on Korey Kauffman’s dad’s truck. He denies seeing people going through the storage containers on the Carson property.

Cooley testifies that Korey Kauffman came over around 4:00PM and stayed around 45 minutes. He testifies that Korey Kauffman came back around 9:00PM-9:30PM and then left for Lander Ave. Cooley admits that he told Kirk Bunch that he had words with Terry Carson around three months prior to Korey Kauffman going missing. He told Bunch in the 04/28/12 interview that Terry Carson came over, and kicked in the side gate. He said that the gate came off the hinges. Percy tries to refresh Cooley’s memory about telling Bunch that Korey Kauffman had left his house around 11:30PM. Cooley would not admit to saying that to Kirk Bunch. Cooley admits telling Kirk Bunch that they needed $560.00 for the tags on Tony Kauffman’s truck that Korey Kauffman was using. A brand new truck does not cost this much for tags.

Michael Cooley testifies that Korey Kauffman ate at their house the night he disappeared. He admits on the stand that he had told Kirk Bunch that Korey Kauffman had left their house around 11:30PM. This contradicts testimony from earlier this morning. Cooley does not remember telling Kirk Bunch that there were only two pipes left on the Carson property the next morning.

Cooley once again admits telling Kirk Bunch that it was Terry Carson who had threatened to shoot him on sight if he caught him stealing from the Carson property. He admits that he told Bunch that this happened 2-3 months prior to Korey Kauffman going missing. Percy states that this must have happened around January 2012 or February 2012. Cooley states that he heard a big bang, and someone had kicked in the side gate of their house. He testifies that the gate came off the hinges. He states the police came over, and spoke to the person who kicked the gate in. Cooley states that he never told Kirk Bunch that this person said that his body would never be found. Cooley states that he told Bunch that the Merced County Sheriff’s Department searched his home before Korey Kauffman went missing. Cooley could not remember telling Kirk Bunch that Frank Carson was his lawyer on 2-3 occasions. He would not admit this even after being refreshed. He is getting very agitated on the stand at this time. Cooley denies telling Kirk Bunch that he had people go onto the Carson property to steal. He denies telling Kirk Bunch that he wanted Eula Keyes to have first dibs on stolen items from the Carson property.

Cooley admits telling Kirk Bunch that he had got loaded weapons from the Carson property. He admits to getting videos, and says he got heroin and crystal from the Carson property. I could see the judge almost laughing to herself on the bench at this time. Cooley could not remember asking Kirk Bunch if he was going to get into trouble. He could not remember this even after being refreshed. He does not remember Kirk Bunch asking him how long it had been since he had taken the guns. He could not remember telling Kirk Bunch it had only been 2-3 weeks since he had taken the guns from the Carson property.

Cooley could not remember telling Kirk Bunch that there used to be a hole in the fence on the 04/28/2012 interview. He could not remember telling this to Bunch even after being refreshed. Cooley tried to insist that there was a hole in the fence when Korey Kauffman had gone missing. He looked kind of pathetic up there at the moment. Cooley admits that he told Kirk Bunch that he used night vision goggles to look at the Carson property. Cooley admits that he told Kirk Bunch that he had seen one person get out of a station wagon that was parked on the Carson property. He admits to telling Bunch that he had seen one person go one way, and another person go the other way. Cooley did not remember telling Kirk Bunch that Korey Kauffman came over around 10:00PM. We are now done with our morning session. I will be there tomorrow morning for more lies on the stand from Michael Cooley.
