Week 12, Day 45 (OH THANK GOD FRANK)

This morning session, we almost saw something that I fear would have been a disaster if it had happened. I was left wondering if it was going to happen, but it did not. As Tom Petty says in one of his songs: “I’m so tired of being tired, but sure as night will follow day, most things I worry about, never happen anyway.”

We start out at 9:26AM, with the continuing testimony of Kimberly Stout on the stand. Defense attorney Percy Martinez starts out with his continuing cross examination of the witness. Percy Martinez starts asking Ms. Stout about when she saw Korey Kauffman at the Mulberry Mobile Home Park in Turlock. Ms. Stout testifies that she saw police come to the park to talk to a Mr. Sweetwater about a stolen air compressor. She states that she did not see anyone arrested that day over the stolen air compressor. She states that the police were at the park for a couple of hours between approximately 6:00PM and 8:00PM. She testifies that Frank Carson arrived at the park with the police. She testifies that they drove up in a vehicle that was not a marked police vehicle, and parked on the street. She states that the police did not talk to Korey Kauffman, and left with the air compressor.

Kimberly Stout testifies that Korey Kauffman and Kevin Pickett were at the park visiting a lady named Wanda. Percy has no further questions at this time.

Defense attorney Hans Hjertonsson takes over on cross examination of Kimberly Stout. Hans reminds Kimberly Stout that she had testified last week that she had known Korey Kauffman very well. Ms. Stout states that she had known Korey Kauffman since he was born and had seen him almost daily. She states that she learned Korey Kauffman was missing in March of 2012.

Hans Hjertonsson gets Kimberly Stout to testify that she had heard threats against Korey Kauffman, but had not said anything about the threats to the police for a couple of years. It was March of 2012 when she first told the police of the alleged threats she had heard. Hans reminds Ms. Stout that she has testified that she saw Robert Woody outside of a black vehicle in front of Korey Kauffman’s home, and had heard a person yelling at Korey Kauffman. He reminds Ms. Stout that she testified that she was about 20 feet away from Korey Kauffman when the vehicle drove away. He reminds Kimberly Stout that she had testified that it took about 45 seconds for the black vehicle to drive past her. Hans reminds Kimberly Stout that it had taken her about 3 minutes for her to pass Korey Kauffman while she was walking down the street in his direction. Hans shows Kimberly Stout that she had told Kirk Bunch on March 14, 2014 that it had taken her 3 minutes to pass Korey Kauffman while she was walking down the street in his direction. Hans reminds Kimberly Stout that she had told Kirk Bunch that she was not sure if the incident happened in front of Korey Kauffman’s house. Hans reminds Kimberly Stout that she had told Kirk Bunch that she was certain that she did not see Daljit Atwal or Baljit Athwal driving the black vehicle.

Hans Hjertonsson reminds Ms. Stout that Kirk Bunch had driven her down the route she had been walking on S. Johnson St. and Linwood St. in Turlock. He reminds Ms. Stout that she had pointed out the areas on the street that concerned her alleged observations that day. Hans shows Ms. Stout Exhibit DA-B, and she recognizes the neighborhood map. Hans shows Ms. Stout that she was approximately 950 feet away from Korey Kauffman’s house when the black vehicle had passed her on the street. We now have a side bar. Hans shows her that the map shows approximately 1000 feet would have separated her from Korey Kauffman’s house when the black vehicle passed her.

Hans Hjertonsson reminds Kimberly Stout that she had not told Kirk Bunch on 03/14/2014 that anyone was screaming at Korey Kauffman. Hans reminds Kimberly Stout that Kirk Bunch had shown her pictures for her to try to identify the driver of the black vehicle. Kimberly Stout testifies that she knows Eula Keyes, and had seen Eula Keyes the same day that Korey Kauffman had disappeared. There was an objection, we have a side bar, and the objection is sustained.

Hans Hjertonsson gets Kimberly Stout to testify that she had told Kirk Bunch that the black vehicle drove around the block, and came back around, and Robert Woody had nodded at her when the car passed her again. Hans has no further questions at this time.

Defense attorney Jai Gohel takes over on cross examination of Kimberly Stout. He reminds Kimberly Stout that she had told Kirk Bunch that she had not heard any threats made to Korey Kauffman during the alleged incident. Jai Gohel now reminds Kimberly Stout that she testified on December 13, 2017 that she was 10-12 feet away from Korey Kauffman when she heard the alleged threats. Jai Gohel now reminds Kimberly Stout that she testified last week that she was around 40 feet away from Korey Kauffman when she heard the alleged threats.

Jai Gohel now reminds Kimberly Stout that she had told Kirk Bunch that it had taken her three minutes to get to Korey Kauffman when she was walking down the street towards his house. Jai Gohel tells Kimberly Stout that she testified last week that a neighbor was out front during the alleged incident. Jai Gohel reminds Ms. Stout that she had testified last week that she had heard 3-5 minutes of threats, and that the neighbor had witnessed the threats that were allegedly made. We now have another side bar.

Jai Gohel points out to Kimberly Stout that she had told Kirk Bunch that the driver of the black vehicle was of medium build and was not Daljit Atwal or Baljit Athwal. Jai Gohel points out that Kimberly Stout had said she thought the person was a relative of the Athwals. Jai Gohel now reminds Ms. Stout that she testified last week that the driver of the black vehicle was small and skinny. Jai Gohel reminds Ms. Stout that she did not say anything about the alleged threats to law enforcement for around two years. Jai Gohel reminds Ms. Stout that she has just testified that she only knows Eula Keyes, but on 12/13/2017 had testified that she had been friends with Eula Keyes for many years. Jai Gohel has no further questions at this time.

Marlisa Ferreira takes over desperately trying to put lipstick on a pig. She has been doing quite a bit of this lately with her witnesses. Marlisa Ferreira starts out by asking Ms. Stout how long the alleged incident took. Kimberly Stout says it took 3-5 minutes. This does not seem to be the answer that Marlisa Ferreira was looking for. She asks Ms. Stout if she was sure of this. Kimberly Stout says: “Yes.” Marlisa Ferreira now shows Kimberly Stout the same map that Hans Hjertonsson had shown her of the neighborhood where the alleged incident happened. With Marlisa Ferreira’s calculations, it is determined that Kimberly Stout was about 500 feet away from Korey Kauffman’s house when the alleged incident happened. Kimberly Stout testifies that it was after the alleged incident that the black vehicle passed her on the street. Kimberly Stout testifies that the neighbor was watching from next door when the alleged threats were made. Kimberly Stout testifies that Robert Woody was outside of the black vehicle when the alleged threats were made, and the neighbor looked after the alleged threats were made. Kimberly Stout now testifies that nothing has changed in her testimony. Oh My God, she is dillusional.

Kimberly Stout now testifies that she saw the driver of the black vehicle before the alleged incident at Pop N Cork Liquors. She testifies that she saw this same person at Pop N Cork Liquors after the alleged incident. Kimberly Stout testifies that the window was up on the black vehicle when Robert Woody nodded at her. Marlisa Ferreira has no further questions. I don’t think the lipstick made Kimberly Stout look any better to the jurors.

Percy Martinez takes over on re-re-direct of Kimberly Stout. He asks Ms. Stout if she was telling the truth when she spoke to Kirk Bunch and Jon Evers. Kimberly Stout: “Yes.” He asks Kimberly Stout if she was around 1000 feet from Korey Kauffman’s house when she first saw the black vehicle. Kimberly Stout now says she was around 1500 feet. I shoot regularly at a gun club. I can’t see anything at 600 feet without my spotting scope. That is a huge distance to be able to see anything. Kimberly Stout testifies that at this ridiculous distance, she saw the black vehicle parked in front of Korey Kauffman’s house. She states that she could hear people yelling at that ridiculous distance. Bullshit she could hear anything at that distance! She testifies that she could hear the words that were said at that distance. Bullshit! Kimberly Stout admits that she had told the investigators on March of 2014 that she was able to hear the words that were said. Now, Kimberly Stout testifies that it was probably 2000 feet. I say Double Bullshit.

It is now 10:35AM, and we take a recess until 10:55AM. When we get back into the courtroom, Kimberly Stout testifies that she was about three houses away from Korey Kauffman’s house when she first saw the neighbor. She testifies that the conversation was over before she got to this point, and the black vehicle had already left. Kimberly Stout states that she did see the neighbor when Robert Woody was outside of the car making the alleged threats. Bullshit! Percy Martinez is now done asking her questions. She is allowed to step down from the stand.

Marlisa Ferreira now calls Kimberly Fletcher to the stand. She is now a district attorney for Orange County, but previously worked as a district attorney for Mariposa County. She testifies that she had worked on a case in Mariposa County where Frank Carson was the defense attorney. This case was happening around March of 2012. She testifies that she had a conversation with Frank Carson. She states that Frank Carson had told her that he would rather represent a murderer than a thief because a murderer is unlikely to murder again, but a thief will likely steal again. Marlisa Ferreira has no further questions at this time.

Percy Martinez takes over on cross examination of Ms. Fletcher. She testifies that the trial was at the Mariposa County Fair Grounds, in rather poor conditions. She testifies that the date of the trial was 03/29/2012. This is a very important date in the world of this case. She denies that she had a bad relationship with Frank Carson. Ms. Fletcher denies that Frank Carson had called her mentally imbalanced. She states that she voluntarily retired from Mariposa County. I think Percy Martinez was trying to show that she had been fired or asked to leave her job. Percy Martinez has no further questions.

Defense attorney Hans Hjertonsson takes over on cross examination of Ms. Fletcher. Hans gets Ms. Fletcher to admit that she has trouble remembering dates. Hans Hjertonsson reminds Ms. Fletcher that Kirk Bunch had called her in 2014 and had asked her a question concerning the conversation she had with Frank Carson. She states she told Kirk Bunch she would think about it, and call him back. She states that she never called him back. Hans Hjertonsson has no further questions for Ms. Fletcher. Ms. Fletcher is now allowed to step down from the stand. We have a side bar.

It is now 11:22AM, and the jury is allowed to go for an early lunch. Ms. Fletcher is brought back to the stand. Things get interesting here folks. We now enter into a 402 hearing on Ms. Fletcher. Defense attorney Percy Martinez starts talking about the Kyle Andrew Hatton case that she had tried where Frank Carson had been the defense attorney. Percy gets Ms. Fletcher to admit that she had contacted Annette Reese of the Stanislaus County DA’s Office concerning a recording made of Kyle Hatton’s father Orb Hatton. In this recorded conversation, Orb Hatton left a voice mail for his son where he admitted to being a “Monster” in his past by sexually abusing children. It is brought out that Ms. Fletcher had held onto this recording for an extended period of time before she contacted Annette Reese concerning the recorded conversation. It is brought out that she turned over the recording after she found out that Frank Carson had been arrested. Orb Hatton was later tried for sexual crimes related to this recording. I am not sure if he was convicted. I think Frank Carson was involved with this case.

At this point, Frank Carson decides to take the stand. Oh my God! He sits down at the stand and states his name. We have a side bar, and Judge Zuniga states that Frank Carson needs to speak with his attorney. We break for lunch. All the people who love Frank Carson are in shock. Many of us caution him to be careful. Ms. Fletcher’s testimony is not important enough to justify opening up this can of worms. Marlisa Ferreira had a strange smile on her face when Frank was sitting on the stand. There was talk of this thing taking the entire day to finish and sending the jury home for the day. Later on, in the afternoon, before I began typing this article, I find out that Frank Carson decided to not take the stand. I think he realized during lunch that this was the wise way to proceed. Thank You Jesus!

  1. Just a note for everyone who reads my articles. Tomorrow, I have two doctors appointments. I will not be in the courtroom tomorrow morning or afternoon. I have been having some respiratory issues related to the smoke in the air that has required some testing. I will be in the courtroom on Friday morning to give you another reporting of what I observe. Tom Jensen
