KIRK BUNCH IS BEYOND TOAST

 

I had the best intentions of attending the entire day of court today, but the extreme length of my article last night got me to bed around 1:30AM. I had just witnessed a day I will never forget, and I wanted to make sure all of my readers could share everything I experienced. I attended the afternoon session today, and what I experienced was simply astounding. Percy Martinez was finishing his cross examination of Kirk Bunch. By the time that Percy was done, Kirk Bunch, and his evil twin sister Marlisa Ferreira seemed to be destroyed. Hans Hjertonsson then took over on cross examination, and continued the slaughter of Kirk Bunch. When Hans was done, Jai Gohel finished Kirk Bunch off with an atomic bomb. Marlisa Ferreira did the best she could to prevent some very damaging evidence, but Judge Zuniga let the evidence come in. This happened at the end of the day, and the jury will have until next Tuesday to think about what they just learned about Kirk Bunch. Bunch was once again beyond cherry red, and was having his weird tongue thing going out of control. Before we went home, the defense attorneys made an announcement that I will save for the end of this article. So sit back, and relax, and let me paint for you yet another picture of this travesty of misjustice.

Court started out this afternoon at 1:50PM with Percy Martinez continuing his cross examination of DA Investigator Kirk Bunch. Percy shows Kirk Bunch Exhibit C-H2-A, which is a flyer that was put out after Korey Kauffman went missing. Kirk Bunch testifies that he saw this flyer after 4/03/2012 when he spoke with Kevin Pickett. Kirk Bunch states that he got this flyer from Detective Ken Barringer. Kirk Bunch testifies that he did not ask Barringer where he obtained the flyer. Kirk Bunch states that he is not aware who prepared this flyer. Percy Martinez gets Bunch to acknowledge that the flyer listed 03/29/2012 as the date that Korey Kauffman had disappeared. Percy Martinez: “Did Kevin Pickett say that Korey Kauffman disappeared on 03/29/2012?” Kirk Bunch: “No.” Kirk Bunch states that he did not talk about the date with Kevin Pickett. I would say that is probably not true. That would be one of the first things an investigator would have asked Kevin Pickett. Percy Martinez now impeaches Kirk Bunch with transcripts from his testimony. Percy shows how Kirk Bunch on 03/28/2019 had been asked some questions by Marlisa Ferreira. Marlisa Ferreira got Kirk Bunch to testify that he got information concerning the disappearance of Korey Kauffman from speaking to Kevin Pickett. Marlisa Ferreira then gets Kirk Bunch to testify that Kevin Pickett had told him that Korey Kauffman had disappeared on a Friday night at the end of March, 2012. This works out to March 30, 2012. Percy Martinez gets Kirk Bunch to admit that he had testified that he contacted Kevin Pickett on 04/03/2012. Percy Martinez: “Did you get information from Kevin Pickett about Korey Kauffman?” Kirk Bunch: “Yes.” Kirk Bunch testifies that he got involved with a missing person’s case on 4/02/2012. Percy gets Bunch to agree that one way that investigators do these investigations is to ping the cell phone of the missing person. Percy gets Bunch to testify around 04/02/2012 Korey Kauffman had just recently been reported missing. Percy Martinez: “Did you get the cell phone number of Korey Kauffman from the family?” Kirk Bunch: “Not at that time.” Kirk Bunch states that he was able to get Korey Kauffman’s dental records, and called the family to get Korey Kauffman’s cell phone number. Percy Martinez: “Did you ping his cell phone?” Kirk Bunch: “No.” Percy Martinez: “Did you ever ping his cell phone?” Kirk Bunch: “No.” Percy Martinez has no further questions at this time.

KIRK BUNCH

Hans Hjertonsson takes over on the cross examination of Kirk Bunch. Hans points out to Kirk Bunch that he has testified that he is an experienced homicide investigator, and had testified that he was more experienced than any of the other investigators in this case. Hans points out that Kirk Bunch should know the importance of documenting his interviews. Hans points out that Kirk Bunch has testified that he did not record his conversation with Detective David Shaw on 04/02/2012. Kirk Bunch had testified that he did not have a recorder with him at that time. Hans Hjertonsson: “Was that an unexpected call?” Kirk Bunch: “Yes.” Hans Hjertonsson: “You were told that Detective David Shaw called you from Michael Cooley’s back yard?” Kirk Bunch: “No.” Hans Hjertonsson: “You heard the testimony of Detective Shaw?” Kirk Bunch: “Yes.” Hans Hjertonsson: “You didn’t hear him say that he called you from Michael Cooley’s back yard?” Kirk Bunch: “No.” We now have a rather long side bar. After the side bar, Hans Hjertonsson asks Kirk Bunch: “Were you here for Detective Shaw’s testimony?” Kirk Bunch: “I have no idea.” Kirk Bunch states his memory is vague, but admits he was present for Shaw’s first day of testimony. Hans Hjertonsson shows Kirk Bunch the transcripts of David Shaw’s testimony on that day. Kirk Bunch admits that Detective David Shaw had told him that he was calling him from Michael Cooley’s back yard. Hans Hjertonsson: “You testified that was 04/02/2012, and took detailed notes, and destroyed your notes. Hans gets Kirk Bunch to admit that he testified that he talked to Kevin Pickett on 04/03/2012. Hans Hjertonsson: “What day of the week was that?” Kirk Bunch: “I don’t know.” Hans Hjertonsson: “You called him?” Kirk Bunch: “Yes.” Hans Hjertonsson: “Did you record the call?” Kirk Bunch: “No.” Hans Hjertonsson: “Did you have a recorder?” Kirk Bunch: “I don’t know.” Kirk Bunch testifies that the conversation with Kevin Pickett lasted around 10 minutes. He states that he had this conversation while he was in his car. He states that he had a note pad, and took notes. Hans Hjertonsson: “Where are the notes?” Kirk Bunch: “I don’t have them.” Hans Hjertonsson:” In your report of 04/04/2012 with Detective David Shaw you said you destroyed your notes.” Hans Hjertonsson: “When did you destroy the Kevin Pickett notes?” Kirk Bunch: “Right after.” Hans Hjertonsson: “That means you wrote a formal report?” Kirk Bunch: “No.” Hans Hjertonsson: “You testified on 03/28/2019, and Marlisa Ferreira asked you about 04/03/2012 and asked you when Kevin Pickett said that Korey Kauffman had gone missing.” Hans Hjertonsson: “You testified that the last time Korey Kauffman had been seen was a Friday?” Kirk Bunch: “Yes.” Hans Hjertonsson: “When Percy Martinez asked you 20 minutes ago about whether Kevin Pickett had given you a day when Korey Kauffman had disappeared, you said “No.” Kirk Bunch: “Correct.” At this point of time, I could see Kirk Bunch turning bright red, and doing that strange tongue things I have written about. He was obviously getting very nervous on the stand. Hans Hjertonsson: “You testified to different things on this?” Kirk Bunch: “Correct.” This gets objected to, and the objection is sustained. Hans Hjertonsson: “Did you tell Marlisa Ferreira about the 04/03/2012 conversation with Kevin Pickett?” This gets objected to, and the objection is sustained. Hans Hjertonsson: “When Marlisa Ferreira asked you last Thursday who you contacted, you said Kevin Pickett?” Kirk Bunch: “Yes.” Hans Hjertonsson: “You said you got information from Kevin Pickett?” Kirk Bunch: “Yes.” Hans Hjertonsson: “Marlisa Ferreira asked you when Korey Kauffman went missing, and you said Friday?” Kirk Bunch: “Yes.” Hans Hjertonsson: “Did you write any report about your conversation with Kevin Pickett on 04/03/2012?” Kirk Bunch: “No.” Hans Hjertonsson: “You destroyed the notes?” Kirk Bunch: “Yes.” Hans Hjertonsson: “Is it the DA’s Office policy to destroy your notes after a formal report is written?” Kirk Bunch: “Yes.” Hans Hjertonsson: “So you violated the policy?” Kirk Bunch: “No.” Hans Hjertonsson: “You also testified about when you took Robert Woody to 838 9th Street, then to Pop N Cork Liquors, and then to where Korey Kauffman’s body was found near Mariposa.” Hans Hjertonsson: ‘How many vehicles went up to Mariposa?” Kirk Bunch: “Four.” Kirk Bunch states that Robert Woody was taken up in one of the officers cars, and he did not drive up in that vehicle with Robert Woody. Kirk Bunch testifies that all four vehicles stopped short of the turn around, but were not in the same location. Two of the vehicles were short of the turn around, and two of the vehicles were in the turn around. Kirk Bunch testifies that Robert Woody got out of the car, and walked down the road about 100 yards, and pointed to the general area where the body of Korey Kauffman had been found. Hans Hjertonsson: “Was this all recorded?” Kirk Bunch: “Yes.” Hans Hjertonsson: “So we can show it for the jury?” Kirk Bunch: “If you want.” Hans Hjertonsson: “You testified that you had a conversation with Michael Cooley on 04/28/2012.” Kirk Bunch gets refreshed on this, and states that he arrived at Michael Cooley’s house around 9:15PM, and left around 9:50PM. Kirk Bunch testifies that he went back to the back yard of Michael Cooley’s house, and Michael Cooley spoke to him about seeing pipes stacked up on the Carson property, and pointed out to him where the pipes had been stacked up. Kirk Bunch admits that he could not see where the pipes had been stacked up because it was too dark. I note that the time was some time close to 9:15PM when Kirk Bunch states that it was too dark for him to see where the pipes had been stacked up. Hans Hjertonsson: “Michael Cooley said that at the end of March, 2012 he saw three people around 9:30PM on the Carson property, and one of them was holding what appeared to be a rifle.” Hans Hjertonsson: “Is it darker in March than it is April?” Kirk Bunch: “I don’t know.” What a dumb ass answer from Kirk Bunch. Hans Hjertonsson: “Are the days longer in the summer?” Kirk Bunch: “Yes.” Bunch seemed to be annoyed to have to admit this on the stand. Hans Hjertonsson: “You said you had briefings with other investigators?” Kirk Bunch: “Yes.” Hans Hjertonsson: “During the 07/14/2012 search warrant at 838 9th Street you saw 100’s of pictures, and were party to briefings?” Kirk Bunch: “Yes.” Hans Hjertonsson: “Were you informed about the pipes?” Kirk Bunch: “Yes.” Hans Hjertonsson: “There were no pictures of the pipes?” We now have another side bar. After the side bar Hans asks Kirk Bunch: “When you spoke to Michael Cooley on 04/28/2012 how far from the fence did Michael Cooley say the pipes were?” Kirk Bunch: “He did not give a distance, he said the pipes were by a truck.” Kirk Bunch testifies that the truck was around 20-30 feet from the fence. Kirk Bunch testifies that the investigators held back the information about the body of Korey Kauffman being found on the top of the ground. Kirk Bunch testifies that on 04/28/2014 he confronted Robert Woody about the killing of Korey Kauffman after he had been captured on a body-wire worn by Miranda Dykes. Hans Hjertonsson: “You testified that Robert Woody told you that Korey Kauffman had been left on the top of the ground.” Hans Hjertonsson: “On the body-wire, Robert Woody also said that he fed the body of Korey Kauffman to the pigs, and never put all the body parts in one place, and cut it up in pieces to have it decompose faster?” Kirk Bunch: “Correct.” Hans Hjertonsson: “Robert Woody also said he burned off the hair, eye brows, and eye lashes, and killed Korey Kauffman all by himself, and pulled out his teeth?” Kirk Bunch: “Correct.” We have another side bar. Hans Hjertonsson: “Last week on Thursday you testified it is common for other agencies to get called out for homicide cases. ” Kirk Bunch: “Correct.” Hans Hjertonsson: “If there were a homicide tonight, would it be common for the Deputy DA Prosecutor and the DA Investigator to be called out there?” Kirk Bunch: “Yes.” Hans Hjertonsson: “When David Shaw called, that is not what occurred.” Hans Hjertonsson: “When Shaw called on 04/02/2012 or 04/03/2012 did you go out to Michael Cooley’s house?” Kirk Bunch: “No.” Hans Hjertonsson: “Did you call Michael Cooley on 1/05/2012?” Kirk Bunch: “Yes.” Hans Hjertonsson: “He did not answer the call, and you asked him to call back?” Kirk Bunch: “Yes.” Hans Hjertonsson: “He did not call you back?” Kirk Bunch: “Correct.” Hans Hjertonsson: “You went to see Michael Cooley on 04/28/2012?” Kirk Bunch: “Yes.” Hans Hjertonsson has no further questions.

Jai Gohel takes over on cross examination of Kirk Bunch. Jai Gohel: “Marlisa Ferreira asked you if you were cross designated as a FBI Task Force Investigator?” Kirk Bunch: “Yes.” Jai Gohel goes over how Kirk Bunch had worked for the Pittsburg, Ca Police Department, and then went to work for the Stanislaus County DA’s Office. Kirk Bunch states that he does not work with the FBI Task Force anymore. He states that he did not go to Quantico for training with the FBI. This gets objected to, and Jai Gohel withdraws the question. Jai Gohel: “Are you a FBI Special Agent?” Kirk Bunch: “No.” Kirk Bunch admits that he had interviews with Baljit Athwal on 07/11/2012 and 03/25/2014. Jai Gohel has Kirk Bunch provide him with copies of the reports he wrote on these two interviews. Jai Gohel asks Kirk Bunch about the 07/11/2012 interview of Baljit Athwal that was done at Pop n Cork Liquors on 1190 East Ave. Kirk Bunch admits that Baljit Athwal told him that he had gone to talk to Frank Carson at his Modesto Law Office, and Frank Carson was handling a pending case against Robert Woody. Kirk Bunch admits that he was told that the Sheriffs were currently looking for Michael Cooley and Linda Sue Burns who were driving a small green station wagon. Jai Gohel shows Kirk Bunch Exhibit #66, which is the stolen book report that Frank Carson had put out. Jai puts the stolen book report on the overhead screen. Kirk Bunch agrees that Baljit Athwal provided him with a copy of this stolen book report, and it contained a Sheriff’s Department Case Number. Listed on the stolen book report were suspects that were Linda Sue Burns, Eula Keyes, and Michael Cooley. It described the small green station wagon that they were driving. Kirk Bunch admits that the report gives the Sheriff’s Department, and Frank Carson, and Georgia DeFelippo as people to contact in case of knowledge of the whereabouts of the suspects. The report listed the Sheriff’s Department phone number, and the phone numbers of Frank Carson and Georgia DeFelippo. It lists the date of the thefts as being 02/06/2011, and states that the thefts had been ongoing for at least one month. Kirk Bunch agrees to all of these details. Kirk Bunch now testifies that Baljit Athwal told him during the interview at Pop n Cork Liquors that Frank Carson had told him to contact the Sheriff’s Department if the subjects were found. Kirk Bunch admits that he asked Baljit Athwal when Frank Carson had spoken to him about this, and Baljit Athwal told him that Frank Carson had spoken to him about one month ago. Based on this, Jai Gohel estimates that this conversation occurred around the end of May, 2012. Jai Gohe points out that it has been stipulated that the incident at Michael Cooley’s house happened on 05/23/2012. Kirk Bunch admits that Baljit Athwal told him Frank Carson had spoken about the thefts, and that the Sheriff’s Department was looking for the suspects. Kirk Bunch states that Baljit Athwal told him that Frank Carson had told him to contact the Sheriff’s Department or to contact Frank Carson. This gets objected to for misstating the evidence. Judge Zuniga looks through the transcripts, and we have another side bar. After the side bar, Jai Gohel asks the same question to Kirk Bunch, and Kirk Bunch admits that Baljit Athwal had told him that Frank Carson had said to contact the Sheriff’s Department or to contact Frank Carson if the suspects were found. Jai Gohel: “Exhibit #66 says to do this?” Kirk Bunch: “Yes.” Jai Gohel: “Frank Carson gave you the paper with the names listed?” Kirk Bunch: “yes.” Jai Gohel: “You asked Baljit Athwal if he still had the paper, and he went home and got it for you?” Kirk Bunch: “Yes.” Jai Gohel: “You asked Baljit Athwal if Frank Carson was angry?” Kirk Bunch: “Yes.” Kirk Bunch testifies that Baljit Athwal told him that Frank Carson was not mad. Jai Gohel: “You asked Baljit Athwal how good of a friend he was with Frank Carson?” Kirk Bunch: “Yes.” Kirk Bunch agrees that Baljit Athwal told him that Frank Carson had helped him one time, and that he only sees Frank Carson at his law office. Kirk Bunch admits that Baljit Athwal told him that Robert Woody said that the investigators should check out the recycling centers. Jai Gohel now goes over how Baljit Athwal had said that Frank Carson had told him: “Thank you very much” and that was it?” This gets objected to, and the judge sends the jury out for a break. After the jury, and Kirk Bunch are out of the courtroom, Judge Zuniga scolds Marlisa Ferreira for speaking after there is an objection.

At 3:36PM, after the break, Judge Zuniga reads the last paragraph in the transcript that concerned the last line of questions. Marlisa Ferreira was objecting to this. She states that the judge had already ruled in the motions illiminae to exclude much of what Jai Gohel was asking questions from. Marlisa Ferreira goes into one of her never ending rants. During her rant, she and Jai Gohel get chastised for constantly interrupting each other. Marlisa Ferreira basically started talking, and would not let Jai Gohel get in a word. Judge Zuniga seems to be leaning towards letting Jai Gohel use the transcript he wants to use. She states she originally struck much of this based on something called “Bruder.” The judge states that this does not apply for the way Jai Gohel wants to use the transcript. Marlisa Ferreira seems desperate, and is acting like a spoiled brat at this time. Judge Zuniga: “Stop talking.” Jai Gohel states he is willing to move on to another line of questions, and will allow this to be decided next Tuesday. Judge Zuniga calls for the jury. We only have about fifteen minutes left in our day. Now comes the atomic bomb from the defense. Apparently, Kirk Bunch has somehow stepped big time on his dick. The defense attorneys announce that they are filing a motion for a mistrial for a discovery violation. Judge Zuniga schedules this for next Tuesday at 9:30AM. All the attorneys agree to this. Marlisa Ferreira, for the first time, looks like she knows that she is defeated. She has a depressed look on her face. Perhaps she should see the same Psychiatrist that Kirk Bunch reportedly sees. Psychiatric help can save lives.

At 3:47PM, the jury is brought back into the courtroom, and Kirk Bunch is put back on the stand. Jai Gohel goes through with Kirk Bunch how he has testified about first taking Robert Woody to 838 9th Street, then to Pop n Cork Liquors, and finally to the mountains near Mariposa. Kirk Bunch: “Yes” Kirk Bunch testifies that it took a little more than two hours to get from Pop N Cork Liquors to the site near Mariposa where the body of Korey Kauffman was found. Jai Gohel: “Was a video taken at Pop n Cork?” Kirk Bunch: “Yes.” Jai Gohel: “Robert Woody pointed out the location where Korey Kauffman was buried?” Kirk Bunch: “Yes.” Jai Gohel: “Was this recorded on the video?” Kirk Bunch: “Yes.” Jai Gohel: “Did Robert Woody speak to Steve Jacobson?” Kirk Bunch: “yes.” Jai Gohel: “You stated it took a little more than two hours to get from Pop N Cork to the site near Mariposa?” Kirk Bunch: “Yes.” Jai Gohel: “You testified there were four vehicles, and they were all law enforcement vehicles?” Kirk Bunch: “yes.” Jai Gohel: “You testified you were in a different vehicle?” Kirk Bunch: “Yes.” Jai Gohel: “You said that Robert Woody got out of one of the vehicles?” Kirk Bunch: “Yes.” Jai Gohel: “There were no other vehicles there?” Kirk Bunch: “I don’t recall seeing any.” Jai Gohel: “On 4/03/2012 you had a conversation with Kevin Pickett to obtain information to help with your investigation?” Kirk Bunch: “Yes.” Jai Gohel: “You asked Kevin Pickett what night Korey Kauffman went missing?” Kirk Bunch: “No, not the way you asked it.” Jai Gohel: “During your conversation with Kevin Pickett did he give you a date?” Kirk Bunch: “He did indirectly, yes.” Jai Gohel: “He said it was Friday?” Kirk Bunch: “Yes.” Jai Gohel: “At the end of March?” Kirk Bunch: “Yes.” Jai Gohel: “To you that indicated 03/30/2012?” Kirk Bunch: “Yes.” Jai Gohel: “Did Kevin Pickett say Friday at the end of the month?” Kirk Bunch: “Not that way no.” Jai Gohel now wants to impeach Kirk Bunch with some transcripts from the trial. This gets objected to, and we have another side bar. After the side bar, Jai Gohel starts reading into the record from some transcripts. He starts reading from the transcripts about the last day Kevin Pickett said he saw Korey Kauffman. This gets objected to, and the objection is sustained. Jai Gohel: “So the conversation you had with Kevin Pickett on 04/03/2012 you determined that the Friday at the end of the month in March worked out to be 03/30/2012?” Kirk Bunch: “I can’t answer that question as posed.” Sounds like Jim Cook to me. Jai Gohel: “You told Marlisa that the date was 03/30/2012?” Kirk Bunch: “Yes.” Jai Gohel: “During your investigation you were aware of an incident concerning Kevin Pickett and Korey Kauffman where the police were contacted at a mobile home park?” Objection, outside of the scope, sustained. Jai Gohel: “The 04/03/2012 telephone call to Kevin Pickett was not recorded?” Kirk Bunch: “Correct.” Jai Gohel: “You took notes?” Kirk Bunch: “Yes.” Jai Gohel: “You did not write a report?” Kirk Bunch: “Correct.” Jai Gohel: “You destroyed your notes?” Kirk Bunch: “Correct.” Jai Gohel: “Were those notes where Kevin Pickett told you that Korey Kauffman went missing at the end of March in 2012?” Kirk Bunch: “No.” Jai Gohel: “Marlisa asked you if you had any animosity towards Frank Carson, and you said: “No?” Kirk Bunch: “Correct.” Jai Gohel: “Marlissa Ferreira asked you if you had targeted Frank Carson, and you said: “No?” Kirk Bunch: “Correct.”

Jai Gohel now goes for the jugular. He brings up a declaration that Frank Carson had made against Kirk Bunch during a Federal case against a man with the last name of Khan. This results in a barrage of objections from Marlisa Ferreira. Judge Zuniga looks through the document. We have a side bar. Marlisa Ferreira loses the argument with Judge Zuniga over allowing the jury to hear the declaration that was filed by Frank Carson. She has the look of death as she walks away from the bench. Jai Gohel was asking the next questions like a machine gun, and I was unable to get some of the questions written down. Bunch had to admit that Frank Carson had accused him of being less concerned about the truth than getting a conviction, the end justifying the means etc. Bunch has to admit that during the Carmen Sabatino case, Frank Carson had accused him of threatening to arrest a witness, and manipulating the statements of witnesses that were interviewed. Bunch has to admit that he was accused of withholding exculpatory statements, or even admitting to the existence of interviews. Bunch admits that Frank Carson accused him of being manipulative. Bunch denies having any bias against Frank Carson. I could see the jury roll their eyes. Jai Gohel destroyed Kirk Bunch. This trial is over as far as I am concerned. The fireworks are over. Only the smoke remains. A cloud in my great crystal ball. (The Firesign Theatre) The judge needs to stick a fork into this thing. Let everyone go home and be free from this abuse. Kirk Bunch and Marlisa Ferreira both make me want to puke.

  1. “Tardive dyskinesia!!” I think Tom nailed the diagnosis.
    That out of control tongue, licking and grinning at the Jury is…Creepy…just Like a crackhead. Like a red faced pedofile on a playground. I guess antipsychotic meds are pretty strong. Like similar to Katamine or Heroin abuse?
    Judge Zuniga is not going to allow a mistrial. Just like every other motion she will find some way to put a Band-Aid on this Money-Sucking illegitimate trial. Or The prosecutor and Zuniga over the weekend will produce by Tuesday some other fake discovery evidence to counter the fabricated discovery evidence in question. This is a never ending nightmare!
