WALTER WELLS/ SCOTT MCFARLANE UPDATE

On May 29, 2020 Walter Wells and Scott McFarlane filed a claim against Stanislaus County in regards to the activities of Stanislaus County District Attorney’s Office in the investigation, arrest, and other activities in regards to the Korey Kauffman homicide investigation.

In their demand for jury trial they claim their fourth, eighth, 14th amendment rights of the Constitution were violated.

They also claim there was false arrest and imprisonment. In addition, they are claiming a malicious prosecution that violated state and federal laws.

Both Scott McFarlane and Walter Wells also claim there was intentional and negligent infliction of emotional distress.

As you all know I was present at every hearing of this debacle for 3 ½ years and I heartily encourage them doing this.

Based on what I witnessed had happened during the investigation and the activities that happened in court.

Initially a claim must be made against the county which they will routinely decline in a specific number of days and then they can eventually move forward into the judicial system.

I will keep you updated as much as I can as the information becomes available, below is the brief that was filed by the multitude of attorneys that are on this case.

GEORGIA DEFILLIPO

Georgia DeFilippo not held to answer in preliminary hearing had paid $450,000 cash in bail money to get out of jail.

CHRISTINE DEFILLIPO

Christine DeFilippo not held to answer in the preliminary hearing.

EDUARDO QUINTANAR

Eduardo Quntanar not held to answer in preliminary hearing.

FRANK CARSON

Frank Carson acquitted of all charges after an 18 month trial and the jury deliberated less than two days.

BALJIT ATWAL

Bobby Atwal acquitted of all charges after an 18 month trial and the jury deliberated less two days.

DALJIT ATWAL

Daljit Atwal acquitted after an 18 month trial and the jury deliberated less than two days.

SCOTT MCFARLANE

Scott McFarlane had his charges dropped for the second time thus ending any of his cases.

WALTER WELLS

Walter Wells still facing charges of conspiracy in a crime that the jury acquitted above.

Charges dismissed against Walter Wells on 12/27/2019. No remaining defendants and no convictions.

ROBERT WOODY

The only one I did not list is Robert Woody who did seven years minus goodtime credits for a crime I believe he did not commit.

  1. What really jumps out at me us that Adam Christiansen is not named in any of the complaints. Corey Brown who was below him was named, but not Adam Christiansen. There is no way this can be an oversight. The timing of Christiansen’s resignation and the filing of the complaints makes me wonder. Has Christiansen agreed to be a witness for the plaintiffs? We will see.
