Good evening everybody. This is Marty from DAWG’s blog with tonight’s podcast on the Frank Carson et al. Trial. Today is Tuesday, June 25, 2019. This is the second day of court this week. We did have an unusual Monday session yesterday in the afternoon. This afternoon went like this morning, but Marlisa Ferreira did get done. She was restricted to an hour in her rebuttal and she wasn’t too happy, but did stay within the hour.

As a note before we start, I got a phone call today of a very interesting, maybe symbolic gesture, about the infamous, one and only, Mike Cooley. There was a Mike Cooley sighting today. Mike Cooley was driving down the middle of the road carrying, I kid you not, an aluminum irrigation pipe. Mike Cooley had an aluminum irrigation pipe struggling to go down Miller Road. It wasn’t just a pipe, it had a valve on the end of the pipe. I’m sure someone just discarded it. I felt it was symbolic as we wrap up the case today.

Marlisa Ferreira is done, we got into arguments this afternoon and many issues came up. She did finish and we will move forward tomorrow with jury instructions and the jury can begin deliberations.

The jury was up at 1:32PM and the Judge was on the bench at 1:33PM. It has been good lately. Judge Zuniga did admonish the jury in regards to the text and slide information that Marlisa Ferreira had put up in the morning. It was not allowed, it was not appropriate and they are to disregard. After all that arguing this morning. That was the end result.

Marlisa Ferreira continued on the rebuttal. They gave her one hour only. I got down what I could, but she was moving at a breakneck pace on the information. She talked about the 3/31/2012 text with Baljit Athwal. At 1:03 AM from his wife, somehow, they are trying to make some significance of that. Daljit Athwal, 3/31/2012, she said 12:22 PM (that would be in the afternoon). On 8/15/15 Jim Cook had read the texts with Daljit Athwal and Sandy Villalobos. There was one other time in 2012, a text, between the two. Baljit Athwal, Jim Cook testified in August 2018, there were texts that no other time was there a gap that large, on 3/31/12 and 3/30/12. She’s making a big deal of this, but Jim Cook didn’t really have the time to go through and so Marlisa Ferreira went through and did this stuff, which brought some comments from the gallery. She said those gaps in responding to the texts, they were rare events for both. Jim Cook testified that the data connections for Daljit Athwal were unreliable because the way data connections work. Again, if you are in Modesto and make a data connection, (you go on Facebook) and then you drive to Fresno and then if you make another connection, it still shows you in Modesto. Until you manipulate your phone with another app, it won’t show that you are in Fresno. She says the connects are always on and it shows the same all over, wherever it was initialized, until you do a manual refresh. Marlisa Ferreira said the defense is claiming the refreshes are not reliable because Jim Cook doesn’t map refreshes. The original tower maintains it, until there is another manipulation. She said data connections are reliable.

Marlisa Ferreira talked about Kirk Bunch’s notes on the Kevin Pickett interview, around 4/4/12, because he didn’t write a report or keep his notes. She talked about 5/6/19, Kevin Pickett testimony, where he said he talked to Kirk Bunch. So Kirk Bunch did not lie. That was a second interview. She talked about Officer Briggs from Turlock PD, she was accused of attacking him. She said no. He said he made contact with Frank Carson that day (at Lander and Montana). Frank Carson said he was watching his property, but, she said, he could only see the Mike Cooley house. Officer Briggs went to the corner of Montana and Lander that morning prior to his testimony to confirm to himself what you could see from there. She said that could lead to more discoverable issues. There were some objections throughout here. She said he was never attacked and did nothing wrong. She said what he did was appropriate. That isn’t what she said at the time, she even chastised him for chewing gum in court.

Marlisa Ferreira talked about Michael Maunakea and the defense saying his story was absurd. Marlisa Ferreira didn’t bring the Turlock PD issues up, she only asked about Korey Kauffman at the house on 9/10/11 and Korey Kauffman statements that date. She said Michael Maunakea’s testimony is undisputed. She had no problems with the officers on the stand who testified for the defense. She also mentioned that Linda Maunakea testified to the same thing.

Talked about the Michael Maunakea seizure in the back of the patrol car and they did a sternal rub on him and he got combative because he didn’t know what the officer was doing. She said Michael Maunakea has a bias against law enforcement officers, but that doesn’t mean he is lying. She said the Michael Maunakea attack claims of the Turlock PD, were brought up by the defense. Marlisa Ferreira admitted to making a mistake of the blurry cell phone picture that was shown to Michael Maunakea and he thought it was the recorder and started crying. She told the jury you cannot hold that mistake against Korey Kauffman, that was her mistake. You can’t hold it against the prosecution and damage her case by that.

She said Daljit Athwal had made comments that Korey Kauffman was not listening, so he had contact with Korey Kauffman.

She talked about all the witnesses, like Michael Maunakea, Romero, Mike Cooley, were all reliable testimony. Victor Navar had informed on several people and the Athwals trusted Victor Navar because they were in the same boat he was in, facing a homicide charge. She said Robert Woody broke down and finally gave in, but she said that is not true. She talked about the Hodsons, John and Ali, the defense is claiming they were not reliable and were treated badly, worse than anyone on this case.

As a note, this morning I was sitting outside the courtroom waiting for it to open and Tom was there with me. John Hodson felt the need to come up and take my picture. He said, “Smile, Gentlemen”. I have no idea what his intention is, but he is upset about his picture on Tom’s report last Saturday. He was the one demanding his picture be removed and he still hasn’t given me a reason. I don’t know what he intends to do with the picture, but he had every right to take it. We were in a public place. I’ll take the publicity. Thank you, sir.

Marlisa Ferreira said the Hodsons were trying to get back at Frank Carson for them getting fired. They did obviously blame Carson for being fired, because they were talking to law enforcement.

And I note, John Hodson has been at court the last few days and he is very friendly with the investigators. He puts his arm around them and pats them on the back. They are laughing and joking. Whatever that means.

Marlisa Ferreira said in his opening statement, Jai Gohel said the DA’s Office wrote a check that they cannot cash, because Robert Woody was coerced. She said the defense did not keep many promises. She said the very people the defense want you to believe are their people (meaning the Athwals). I don’t know what she meant by that.

You heard from and antique dealer that he had signs that were stolen. Frank Carson called the cops and they were confiscated because they were stolen property.

She said the defense had argued that Robert Woody had nothing to do with the disappearance of Korey Kauffman. She said the problem with that is Robert Woody plead out to a manslaughter charge. Robert Woody had made statements to family that he felt ashamed and disgusted for what he did. She asked, did Kirk Bunch threaten Robert Woody with the death penalty in some of the interviews? He also talked about special circumstances that lead to the death penalty. She said: read the transcripts, Kirk Bunch never said that. (Actually he did, I heard him in some of the interviews). The body was buried by the store prior to Robert Woody’s arrest. Kirk Bunch, she said, always said they wanted the truth, talking to Robert Woody. Robert Woody minimized his conduct or was innocent? The defense made both arguments. He was an aider and abettor to a crime. She said the defense claimed that Woodrow Woody, Jr. was just trying to help Dad to get a deal.

Jim Cook did an independent analysis to get accurate information.

Marlisa Ferreira talked about Patrick Emery. She said the defense is saying he’s a high level guy in the military. Patrick Emery wore his uniform, and that did not set well with Marlisa Ferreira that he wore his uniform, it was unrelated to the military event. She said he was trying to impress the jury and it is a misuse of uniform.

She talked about the information in regards to Robert Woody and that Walter Wells mentioned something about Robert Woody being suspected in the disappearance of Korey Kauffman. The tow company said on 4/9/12 that the cars were towed, it was not August. So Patrick Emery changed the dates and it was an untrue date in regards to Walter Wells Sr. when he had passed and they had his funeral. Patrick Emery admitted to being so drunk, he was sick the next day. So his timing could be off because he was so drunk.

Korey Kauffman was with Kevin Pickett on March 29, 2012 and then in Turlock and was not in Mariposa like Sharee Hendrix said.

She talked about Mr. Borba who lived next to 838 9th St. He had not seen or heard anything, but his bedroom window faced the lot. But he was an older guy who needed help around the house, so he may not have heard anything.

She said Kathy Grinolds heard the shot and the room lit up with objections. The jury was out at 2:14PM. So they were in the room about 43 minutes. This got animated. Finally the Judge looked at the testimony of Kathy Grinolds and Kathy Grinolds said she heard shots, but was not sure which day she heard those shots. Marlisa Ferreira was disagreeing with her and she wants a citation in the transcripts of what she is talking about. Judge Zuniga went into chambers to research the transcripts. Apparently there were some real problems with the transcripts. Somebody (the defense) was looking at transcripts that weren’t certified, that is what it sounded like and the prosecution was looking at the certified transcripts. So one says one thing and one says another and I can’t imagine why they would be different, but they are. One the official transcript it does say she heard gunshots near that time, but it doesn’t say that particular day. Hans Hjertonsson said yes, it says she heard them around this time. Marlisa Ferreira said the same thing. They were actually agreeing, but arguing about it. The Judge is going to allow Marlisa Ferreira to read the transcript to clarify everything. Hans Hjertonsson mentioned that Marlisa Ferreira only had 19 left to do her rebuttal and that set Marlisa Ferreira off again. The Judge did give her a time limit. She said she had until 2:55PM to finish. Marlisa Ferreira was definitely arguing with the Judge, she wants to object for the record and she is not happy. The Judge said we need to get this jury out and deliberating. We are running out of time.

The jury was up at 2:42 PM. Marlisa Ferreira was reading the transcript to the jury of Kathy Grinolds. She said she heard the shots and she said she did see Daljit and Baljit Athwal on the platform above the garage on that particular date. But she didn’t remember at the time, she remembered when she saw their pictures in the media and she had been at Pop and Cork and then it dawned on her that it was “the guys”.

Marlisa Ferreira showed a picture of Frank Carson with a box of bullets in his house.

She talked about Baljit Athwal is a man who hunts. Korey Kauffman was found where people hunt.

Scott McFarlane put a garden in. She showed three different pictures of google maps of the discoloration of the Pop and Cork lot where Scott McFarlane put the garden in and that was also the gravesite.

The pathologist, she said, he said there would not be any odors emanating because of the body being wrapped in a tarp. (Not exactly what I heard, but OK).

Out of the 130 witnesses, the defense says they are all lying, but they don’t each other and they told the same story.

She talked about 3/29/12 Korey Kauffman’s cell phone was hitting sites and sectors in Turlock. That proves he was in Turlock and it shows in the CDR’s. She put up a slide with the cell phone tower and it ended up into a messy situation again. There was an objection to that slide and the jury was out at 2:50PM.

They went to a sidebar, very animated. The Judge is not happy. Marlisa Ferreira was very unhappy, kind of in a snit. She said this document was the one that Hans Hjertonsson had put up in his argument, it is a Jim Cook cell site and sector of the SE and SW of the SE Turlock tower and it has all the calls of 3/29 and 3/30 and Jim Cook testified to all that. She said it was used by the defense in their rebuttal, cross examinations and closing statements.

Hans Hjertonsson said Marlisa Ferreira is using a slide that was used in the preliminary hearing, not this trial. She is using one slide that says it is a 110 degree sector that does not exist. Judge Zuniga got pissed off because her arguments are getting personal, and they were, they were talking about each one lying. She’s not happy when this happens. Jai Gohel said there was no testimony in the trial about this particular slide and the preliminary hearing testimony is not argument, it is misleading. On 3/30/12, Korey Kauffman not hitting off of Mike Cooley/Frank Carson properties. There is no cell phone evidence that says that. She is mis-stating the defense’s argument. Marlisa Ferreira said she never said the 30th, she was talking about the 29th and trying to prove Korey Kauffman was not in Mariposa, like Sharee Hendrix said.

So Marlisa Ferreira put the two slides side by side and they are different colors and the information is exactly the same. The slides are also numbered different in the bottom right hand corner.

Percy Martinez, who has not been there the last two days, his brother was filling in, I believe his name is Dan (?), he said it is misleading and creates confusion in the jury room.

Marlisa Ferreira said it is not misleading it is just an argument. They reacted to something that is not reactable.

Judge Zuniga says the attorneys are arguing different inferences that they see in this evidence. The Judge noted it is unusual for preliminary hearing evidence to be used in closing arguments. She needs to clarify to the jury. Judge Zuniga also noted there were two jury instructions that are left to be finished so she wants to do that today. Marlisa Ferreira should finish at 3:45PM.

The Jury was up at 3:23PM. Marlisa Ferreira did clarify for the jury in regards to the page numbers. She started talking about the cell sites that Korey Kauffman was hitting. It does show Mike Cooley and Pop and Cork.

She also noted that Robert Woody said that Baljit Athwal should have hid the body better.

She said the defense downplayed Praveen Singh’s office invasion as an employee was shot at the office.

She talked about Michael Maunakea and the cell phone information.

She talked about Victor Navar, a hard core criminal that lied about much, but he never did call 911. The Victor Navar case is not before the jury now, these defendants are.

She talked about Jeff Ligero and his testimony on offers to Victor Navar. Navar ended up getting 21 years. He got 5 years off for testifying in this case and 5 years off for testifying in his cellie’s case. He is looking at a manslaughter case. The defense is claiming there are many witnesses who want to settle a score. In the Robert Woody interviews, the defense is claiming that Domby said the time has passed/this ship has sailed. That Domby said they didn’t go up that night.

She pointed at the three defendants and said these men are not innocent. She said Frank Carson thinks the way he acts is for the greater good (or something to that effect). She says it is not OK to kill a young man.

Baljit Athwal relationship with Frank Carson, he has called him many times at his office and she says they have no idea how many throw phones they used. The Athwals wanted to help Robert Woody, so they fixed his teeth. Robert Woody was fired for stealing soda, “of all things,” she said.

Then she put up a list of witnesses and went through those witnesses so fast, I didn’t have time to look at the list. The first name on the list was Patrick Hampton. She moved extremely fast. It is a document that will apparently be made available to the jury.

Robert Woody said Korey Kauffman was shot in the back. Faye Springer said there were holes in the back of the shirt and jacket.

Frank Carson, she said, asked for a favor. For Robert Woody to threaten Korey Kauffman.

There were conversations at Pop and Cork, talking about Kauffman, some of the things he was doing.

Baljit and Daljit Athwal had baited the property with pipes. Baljit and Daljit Athwal gave Korey Kauffman the worst beating in his life and then shot him.

Baljit Athwal used his truck to go to Mariposa and Robert Woody confirmed. Kirk Bunch said Robert Woody pointed and directed Cory Brown to where the body was and came within 5 ft.

She said Baljit Athwal reported his truck stolen.

There was blood on the back of the jacket.

The Athwals kept telling Robert Woody to keep your mouth shut.

Frank Carson hired private investigators.

She talked about cutting off the fingers and toes.

Frank Carson told them to use throwaway phone. Frank Carson told them to file lawsuits, which the Athwals had done. There was an objection.

Marlisa Ferreira put up a chart of statements by investigators. Another objection that went to a sidebar. It was a long sidebar. She came back and took that down and put up a reasonable doubt explanation. She said the defense used smoke and mirrors. So many imaginative things have been put out by the defense. Their statements are everyone is lying. She said 187 PC is an unlawful killing of a person, she said lying in wait and two shots, maybe three in the back. Witnesses saw patrols on the property.

Baljit Athwal’s intent was to beat Korey Kauffman and burn his truck after Korey Kauffman was killed. Then he denied knowing Korey Kauffman. Baljit Athwal had taken a loaded firearm to the property and had told Robert Woody to shut up and they did show up in the same cell site.

Frank Carson made threats, talked about guards, solicited people, Patrick Hampton mainly. He ran for DA to stop the investigation and he represented Robert Woody asking him for help. She said this is first degree, 187 homicide, due to the threats. There is no second degree or voluntary manslaughter here.

She said the defense is claiming there are biases, but no witnesses have said that. Defense attorneys are not guardians of the constitution. Juries are the one that do that. She said the post-murder silence is deafening. Apparently, there were no issues on the property after Korey Kauffman went missing. Praveen Singh said Frank Carson told him there was no longer a problem, he took care of.

Showing an array of pictures, the defense should be ashamed of what they did and Korey Kauffman is the victim here. The Kauffman family was upset and crying at that point. I do feel for these people.

Dan Martinez, sitting in for Percy Martinez, had claimed to the Judge that Marlisa Ferreira was crying at the end of her argument. I don’t think so, her voice cracked, but it was coming from the gallery and the Kauffman family. There was an advocate for the DA’s office that was also crying. Marlisa Ferreira was done at 3:48PM.

The jury was sent out. They are coming back tomorrow morning at 9 AM. We will go into deliberations. Everyone will be relieved to get this done and over with. It has been an ordeal for many people, especially the families and defendants.

Good evening everybody. This is Marty from DAWG’s Blog with tonight’s podcast of the Frank Carson, et al. Trial. Today is Monday, June 24, 2019. Yes. We had court on a Monday. We are in the final arguments today. Marlisa Ferreira was doing her rebuttal to the defense final summations.

One thing of note before I get started. I got some emails today from a witness in this case. I’m not going to identify who they are. They know who they are. It is two of them. The first email was: rem I take their pictures off the website. That doesn’t work well with me because I’m a D*&#. After a few more emails were exchanged, their response was they are going to get an attorney. That’s fine. Their business must be doing so well now they can afford to pay attorney’s fees. I asked them if they feel they have a legal cause to have those pictures removed and they never responded to that, just demanded I remove them immediately. I have a disclaimer on my site that all the pictures on my site are received via internet. If anyone has a problem and can give me a good reason why a picture should be removed, I will do so. If you get nasty with me right off the bat, that won’t work with me.

Court started at 1 PM this afternoon. The jury was up at 1:07PM. The Judge was on the bench at 1:09PM. Marlisa Ferreira started talking about the Frank Carson issues. (She is going person by person). They are accusing Steve Jacobson of being biased. Steve Jacobson did not come on the case until 2014. Steve Jacobson had no personal contact with Frank Carson. Steve Jacobson ran the wire tap and handled Robert Woody. He did some search warrants too. She said the defenses’ claim that Steve Jacobson is biased is the 90’s is not relevant. She said something I thought was interesting: You can trust the government, the government is here to help you. It surprised me the way she said it. Steve Jacobson testified Frank Carson had filed declaration of a whole bunch of bad things about him. He was not on the witness stand to testify that these declarations were true. She said people love to talk and that is all it is, just talk. Frank Carson trying to undermine the integrity of the officers. Frank Carson could have filed complaints with appropriate agencies at the time. There is no proof. It is just Frank Carson talking. It amazed me she said that, that is one of the overt acts she said against Frank Carson is that he filed complaints with their agencies against the officers.

Kirk Bunch called Frank Carson a rat and then threw him under the bus. Kirk Bunch and Steve Jacobson testified in regards to the allegation. None of it was true and it did not affect them. Thirty years of experience and not one piece of evidence of Kirk Bunch lying on integrity issues in court. Kirk Bunch and Steve Jacobson were over diligent, concerned about the victims family and just simply looked at the evidence. Then in 2013 they were worried about the homicide of Korey Kauffman when the found the body. In April 2012 Kirk Bunch wrote that Frank Carson had a motive. He did research on the property, Frank Carson had contact with law enforcement officers (Turlock PD). Kirk Bunch knew Mike Cooley and Dave Shaw. Dave Shaw heard about the threats by Frank Carson.

She talked about the Carmen Sabatino case, it was a hung jury, not an acquittal. She says it wasn’t a loss for the DA’s office. They did not refile the charges after the jury hung, 11-1 in favor of acquittal. It is not a vendetta.

They accused Mike Cooley of fabricating the pipe story. Robert Woody said Baljit Athwal had baited the property, so it confirms what Cooley said. She talked about Eula Keys, Linda Sue Burns and the rest of the Cooley Clan, they all said the pipe was used as bait. Ricky Cooley ID’d Frank Carson as the one on the property. She said people are human and stories change and tend to morph a little bit.

There are 400 people that were interviewed in this case. It is a huge case. Many agencies involved and there are a massive amount of officers. All witnesses have different vantage points and Mike Cooley said it was Frank Carson’s brother. The witnesses saw a private investigator looking in the cars and they said Frank Carson said he was his brother, a private eye.

She talked about Praveen Singh’s own friend, said Frank Carson had threatened to kill who ever was stealing on his property. The witnesses said the same thing of the threats. Frank Carson said there was a path to the Mike Cooley house with property strewn down the path. The officer never saw the path or any belongings. She said these witnesses are thieves. Their word is not black and white, there are shades of gray in their testimony. There are many bad people in this world, but mostly good people. There are many reasons for people to steal, addiction is one of them. She talked about mental health issues and other things too. Mike Cooley told the truth about his life and was honest about what he said. Not one person lied about their criminal past. Officers weren’t able to locate stolen property at Mike Cooley’s house when they searched.

She said why didn’t they pink Korey Kauffman’s phone? Mike Cooley wasn’t interviewed until 4/28/2012. The phone had been off two weeks and you can’t ping it when it is off. They can’t show the 29th and 30th because they weren’t aware of the information at that time. She said the defense threw up smoke and mirrors that are distant from the facts. The defense said that Kevin Pickett said the 29th, but we had all these people, admittedly career criminals, saw Korey Kauffman on 3/30/2012. Marlisa Ferreira said she works for the people For the people of the state and is an advocate for public safety. Korey Kauffman never came home on the 29th, she said that is probably right. There is one member of the family who said they saw Korey Kauffman on the 30th and 31st too. Kauffman had told Mike Cooley he was going over to steal the pipes, but left in a different direction out the front door and then said something about going over to the mill to do some scrapping.

Marlisa Ferreira talked about Jim Cook. He had billed $354,000 prior to his testimony. So there was his testimony + $354,000. She said the defense over exaggerate what he got. She said Jim Cook’s maps don’t accurately represent the towers and obstructions of those towers. Jim Cook goes to the towers, looks for obstructions and takes pictures and has all the information readily available.

Marlisa Ferreira said then you look at Dr. Richard Leo. The defense also spent money on this expert. Jim Cook was paid $400,000. Dr. Leo was paid about $104,000. The big difference is that Jim Cook was hired in 2014 and looked at a million pages of call data records, powerpointed 1,000 slides and it comes out to about $40,000/year average. Dr. Leo was hired by the defense and he couldn’t say certain things, he could only talk about the techniques. Dr. Leo only gave no usable conclusion. Robert Woody was never interviewed by Dr. Leo. There is no way they could determine the effects without interviews and background.

There was an objection and sidebar.

Marlisa Ferreira said something to the effect, they got more bang for the buck out of Jim Cook.

She said Kevin Pickett didn’t say there were issues with Korey Kauffman and the Athwals. On the other hand, other witnesses said that Korey Kauffman told them he had issues with the Athwals. Scott Rollins said he watched the video, but didn’t know Korey Kauffman.

She talked about Kevin Pickett’s testimony. She said there was street talk. Kevin Pickett had mentioned the injury to his hand. Kevin Pickett put up flyers and looked around the area. She said Korey Kauffman injuries were in November 2011, which required major surgery. Korey Kauffman had helped somebody cut down a tree in January of 2012. Eula Keys saw him pulling a dolly behind his bike with that bad hand.

She said Mike Cooley described Frank Carson as his brother. He told Kirk Bunch it was his brother, until Kirk Bunch showed him a picture of Frank Carson. Why, she said, would Mike Cooley lie? Dave Shaw did not see the pipes on the property, but Mike Cooley told him about it. Mike Cooley pointed out pipes later to Jon Evers and Frank Navarro. If Mike Cooley had killed Korey Kauffman, why would he report him missing? Why would Mike Cooley cooperate so much? Others described Mike Cooley as upset and crying.

Faye Springer talked about the slits in the underarm of the jacket and shirt. In 2016 Robert Woody had already said that Daljit and Baljit were on the Frank Carson property. They were spot checking the property, as many other witnesses have testified about the Athwals. Many people saw and used the hole in the fence. Ryan Schmidt says the fence was fixed in 2011, but said people still were going onto the Frank Carson property.

She started talking about Robert Jaquish who got caught on the property. There was a major objection and sidebar. In the Ramey warrant, Robert Jaquish was quoted as saying, he got caught, there was a bulge under his shirt, but he didn’t see a gun. They used this as evidence that Frank Carson liked to use guns. He was caught in the barn, escaped and waiting in the park for 4 hours to turn himself into the police for trespassing. He has since passed away. They really weren’t allowed to talk about this evidence. After the sidebar Marlisa Ferreira moved on to a different area.

Marlisa Ferreira said there were no incidents in 2012 with Mike Cooley, but she says there were two in 2012. The gate kicking incident and Sabrina Romero heard the gate being kicked open and Frank Carson was in his car and got checked on by Officer Briggs, surveilling the Cooley property (the prosecution says). Eula Keys testified truthfully and it was a little different than Mike Cooley, but she didn’t see anything in anyone’s hands coming off the property.

Scott Rollins was given a deal? No. He was given immunity. There is a difference.

Sabrina Romero was given a deal? No She was given immunity. She had a pending case, so she had to give her immunity.

Marlisa Ferreira said a deal changes charges or time given. Well, that is exactly what happened, the charges were reduced dramatically.

Victor Navar and Robert Woody were given deals. Charlie O’Dell got a deal. If they lie, it is perjury and it is something they can do time for. They don’t want to be charged with perjury. Many of these people were problematic people, but not necessarily people who are liars.

Law enforcement officers who went to Frank Carson’s office, like Ken Barringer, in regards to Korey Kauffman. Frank Carson demands the questions be put in writing. Frank Carson wanted to know which investigators involved. It was Kirk Bunch, Frank Navarro, Steve Jacobson, Jon Evers? Frank Carson wanted information on these investigators so he could file declarations. She said it is a defense trick to distract from the evidence. Who has a motive to lie? Frank Carson facing homicide? Or Officers who have many cases pending and could be doing other things. She said Frank Carson was the provoker. The officers were just doing their job. Kirk Bunch did go to other areas to look for evidence, not just the Frank Carson property. She also mentioned in that office visit that the officer’s voices were calm, cool and collected and they weren’t out of control like Frank Carson was. Frank Carson had called his wife after the search warrant, the day after. Frank Carson did deny involvement talking to Georgia DeFilippo. Frank Carson said something to the effect, they can just go F—- themselves.

On July 15, 2012 the search warrant was done with dogs. They think Bobby was on the property. No one has talked to him yet. Marlisa Ferreira said, why would he say something like that? Then Frank Carson says: F&&^ them. She says why was he so angry? Frank Carson thinks they are tracking phones? It shows consciousness of guilt and state of mind. Except for the fact that they were wiretapping his phone.

Georgia DeFilippo called Frank Carson and said: Oh, they didn’t find any bodies out there? Frank Carson said No. Frank Carson told her the theory is that he hired people to kill other people and asked Baljit Athwal to keep his ears to the ground. I believe he said something to the effect the Indian guy keep his ears to the ground.

On July 15, 2012, Frank Carson told Ryan Schmidt they were just trying to work him over because they want him to come down the property so they can talk to him, because he had to make arrangements to buy new locks.

Marlisa Ferreira said Frank Carson had put some fear in Ryan Schmidt and formed an alliance. Frank Carson said he was going to deal with these “idiots”. Ryan Schmidt and Frank Carson were talking about the thefts by “dirtbags”. He called them F*&^ing crank addict was missing. Frank Carson said they were harassing the Indian community and Atallah (?) had worn a body wire. Frank Carson advised them not to talk to law enforcement. They were claiming they were getting harassed. Frank Carson wanted law enforcement to put their questions into writing for him. She played the audio of the body wire. Frank Carson said he had filed written complaints in regards to officers and also filed lawsuits and then some of the investigations were stopped. She said Frank Carson’s mother called him and told him they have a warrant and want to send the dogs on the property. He told her not to let them unless they have a warrant. Mike Cooley didn’t say that, he gave consent to search his property (I believe he was on probation though, so I don’t think he could have stopped it).

Marlisa Ferreira said this is primarily a homicide case and the defense’s claim that there is no hard evidence. How do you get hard evidence and what is normal? A circumstantial case is just as strong as an evidential case.

Marlisa Ferreira said many people saw Korey Kauffman on the 29th and 30th. Charlie O’Dell said Mike Cooley was dirty and said he just gotten rid of somebody when their car broke down. She said that is direct evidence (when somebody sees something). Hard evidence is direct evidence. Faye Springer testified to the bullet holes. They know Korey Kauffman was shot.

Kirk Bunch testified that Robert Woody, even though they didn’t have it on video, in Mariposa, he walked the road after making the turn and then walked to the spot where they put the body. They didn’t take video of that, but Cory Brown was down in the ravine and Robert Woody telling him to go. She said Robert Woody came within 3-5 feet of where Korey Kauffman was found. She said direct evidence in a circumstantial case in the eyes of the law is the same thing.

Frank Carson kept telling people over and over again not to talk to law enforcement.

Robert Woody testified he was telling the truth on the stand. She says it does not make sense, if people who don’t know each other are saying the same thing when they come in to testify.

The hallway incident with Steve Jacobson and Frank Carson. She said Frank Carson was the aggressor and provoked Steve Jacobson, creating drama. She says Alice Mims, 16 years later was still nervous and scared. She said Frank Carson screams, cusses and yells and it makes people afraid. Steve Jacobson was trying to diffuse that hallway incident. Frank Carson was trying to provoke him by pictures. She said Frank Carson and the Athwals are the aggressors in this case.

Marlisa Ferreira talked about Gary Harmer on blood analysis. When clothes and boots are exposed to the elements for 1 ½ years and samples degrade. They left the body on top of the ground for it to decompose. They did it deliberately.

James Emile, DOJ testified the 22 caliber bullet was most likely a Marlin rifle, there were 6 grooves. Scott McFarlane had a broken down barrel with a receiver on it, that he said he got a garage sale. She says, who buys that?

Steve Jacobson acts did not create a vendetta.

Marlisa Ferreira talked about Roberty Woody had cut off the fingers and toes, but the defense is saying total hands and feet are missing. She said animals are attracted to blood. She said the boots were torn apart by the animals up there, the tongues had been removed or torn out.

Praveen Singh is saying that he was a Fresno cop in the Federal Court case, but she noted Frank Carson had put Praveen Singh on the stand. He knew what he was going to say. She said Praveen Singh and Frank Carson knew each other. She said Praveen Singh is a Frank Carson person, not theirs.

Robert Woody, Marlisa Ferreira said, did not know Korey Kauffman.

Frank Carson told Praveen Singh that he took care of the problem of the thefts. He said the problem has been taken care of. She said the defense claims that Frank Carson at the flea market on Tuesday, but there was no testimony that he was at the flea market. Why lie to the office, if he was at the flea market, everybody knows he was a collector?

Was Eula Keys the only one that was calling Korey Kauffman’s phone? Law enforcement officers went to Frank Carson’s office and they were very calm, cool and collected and Frank Carson was the only one getting excited.

Marlisa Ferreira talked about Daljit Athwal. The Miranda Dykes body wire, said the body was on the ground and Robert Woody said Korey Kauffman was just wearing a shirt. Robert Woody had told family what had happened. Law enforcement officers were just following the evidence and Robert Woody was arrested. Robert Woody came to them, Victor Navar and Praveen Singh came to them to testify. The defense is claiming that Bruce Perry was not doing his job (it was actually Martin Baker). Robert Woody pled no contest to arson and manslaughter. He got 7 years and 4 months.

Oh by the way. This is me, not Marlisa Ferreira. When Robert Woody gets sentenced, because it has been some time now, it has been very close to time served. He is getting sentencing credits now, even though he is not sentenced.

Marlisa Ferreira said Robert Woody said Daljit Athwal and him had gone to the property after closing the store. Baljit Athwal was at the property and Daljit Athwal told Robert Woody, lets go, we have something to do. Robert Woody was trying to stop the Athwals from beating Korey Kauffman. She said Robert Woody not believable? He had told family about what had happened, his son and Robert Branco.

Marlisa Ferreira said the Jim Cook information showed who had Korey Kauffman’s phone. She is showing CDR’s on the overhead.

Eula Keys was calling Korey Kauffman’s phone, so was Kevin Pickett, Sandra Pickett and Laurie Freitas were also calling. Many other calls other than just Eula Keys. Sandra Pickett was calling repeatedly. Some were called when the phone was on and some weren’t, but every time Eula Keys called the phone was on. She says it is all smoke and mirrors.

She talked about the Jim Cook slides and his mistakes. The Big Oak Flat. for demonstration. is not to scale. Jim Cook corrected it on the stand and she said that actually enhanced the sector and put him more in the sector and didn’t change anything. (that’s not how I remember it).

Marlisa Ferreira talked about the 31 minute gap between texts from Sandy Villalobos until Daljit Athwal had responded.. She had Jim Cook, just check the ones in 2012. Jim Cook did not count other ones longer and the defense had him do more. She said there was a total of over 3000 texts between those two. That makes Jim Cook’s maximum percentage of error at 0.007%. She said there were four occasions after 11 PM that he did not call her back. She said it was weird there was an event that takes 31 minutes for him to respond back.

She said talking about Daljit Athwal’s cell phone information, the Frank Carson property is outside the overlap by 10-15% was changed a few years ago from 5-10% that is why there are differences in Jim Cook’s testimony.

On 838 South 9th Street, there were some obstructions that caused an overlap in this tower. She was putting up Google maps on the overhead and the AT&T cell tower site had Korey Kauffman’s phone. The SE Turlock Tower in the SE sector, which she is saying Frank Carson’s property was in. The SW sector does cover the property unless something is moving around. So it causes an obstruction for the other sector to pick up. Obstructions change sectors.

She talked about Christine DeFillipo’s text with her Mom with Frank Carson being on the property. She says there were activities that were 5 sec long calls on the different sectors. There are several dates she mentioned that Christine DeFilippo was vacillating between sectors. There were texts being sent that night. Going over a list of sectors that were done that night. She was changing sectors, obstruction causes changes of sectors. She made it sound like she was walking around the property.

Jim Cook did testify that Frank Carson’s property does stay in the SE sector. Jim Cook uses CDR’s and the defense agreed to some of the connections and vacillations in those sectors. Then in 2011 or 2012 or both, and some 2014 there were some other calls and texts also by Christine DeFilippo and others. There were vacillating between area sectors in those towers.

That is where we were at the end of the day. She still needs to finish Daljit Athwal and then go through Baljit Athwal. She will finish tomorrow. My understanding is the Judge gave Marlisa Ferreira a time limit tomorrow to finish.

We are starting at 9AM tomorrow. The Judge wants the jury to get instructions in the morning and then begin deliberations tomorrow. If it goes into next week, there are no court days with the jury in the month of July.

Good afternoon everybody, this is Marty from DAWG’s blog with tonight’s podcast on Wednesday, June 19, 2019, this is on the Frank Carson et al. trial. We’re in the closing arguments stage. We finally got through the year and a half of a trial and we’re getting close to the end of this thing — finally! This afternoon the jury was up at 1:28 PM. The judge was on the bench at 1:30 PM. The timing has been very good lately, getting the way it’s supposed to be done. Percy Martinez is doing his final argument, as he was this morning and he did finish up this afternoon.

Percy Martinez talked about James Emile with the Department of Justice who actually dug the hole in the Pop and Cork lot where Robert Woody said they buried the body. He found no evidence of blood, found no evidence of tarp residue, they’re saying there would be little flakes that little blue tarp stuff, no evidence of decomposition which would show other evidence such as insect activity. There would be dead insects and things like that when there’s decomposition. and there is no evidence of that there is no confirmation that the hole was actually ever dug. He says there may have been a previous hole, but it was only 14 inches, not two and one half feet, like Robert Woody said. Robert Woody said they used a backhoe on it prior to bury garbage, but there was a pipe that went through that hole, a gas line, they would have torn up if they had used a backhoe. Robert Woody said he never came across a pipe.

Percy Martinez said there’s no hard evidence in this whole case. He says this is just one example, there is no hard evidence. If they had found DNA or otherwise there would have been hard evidence. If they would’ve found something substantial that could be scientifically acknowledged that something had happened there, but there was no DNA, no forensic evidence, there is no hard evidence anywhere in this case. All they have is testimony from a lot of people, but mostly Robert Woody.

He talked about Officer Vento. The Sheriff’s car came over to the Cooley property from the Carson property after investigating Frank Carson reporting a burglary, one if his containers or something had been broken into. In that report by Officer Vento there was no mention to him of any threats being made to anybody about shooting them or anything like that. No one had talked to the Officer that there was anybody going through cars, this is something that came up later. Marlisa Ferreira was saying that Frank Carson is a bad man, was based on lies.

In regards to the cell phone that Praveen Singh said Frank Carson used, records from November of 2013 to August of 2014 are the only records that exist for this phone. Prior to Praveen Singh’s arrest there were no calls made to or from that cell phone. The phone was used for 10 months, but was supposed to be a throwaway phone. That phone never called Baljit Athwal, Daljit Athwal, Robert Woody, Eddie Quintinar, Walter Wells or Scott McFarland. There were a few calls to Georgia DeFillipo and one other person and that is all. It was registered to Dana DeFillipo, Georgia’s daughter.

Percy Martinez talked about Steve Jacobson and Frank Carson had a long standing, problematic relationship. This goes back to the ’90’s. Steve “the juice” Jacobson said he had no bias, but when he called Frank Carson “a fat boy” in court one day while he was sitting in the courtroom, waiting, he called Frank Carson, “hey fat boy”. Steve Jacobson obviously didn’t like Frank Carson. He confronted him when he worked for the public defender’s office in the 1990’s. In the courtroom hallway testimony. Steve Jacobson was across the hall and confronted Frank Carson, not the other way around.

Remember Alice Mims (County Counsel) testified she was sure Steve Jacobson didn’t like Frank Carson in his face like that. She said Frank Carson got in his face. Percy Martinez argued Jacobson was across the hall, approached Carson and knocked the camera out of his hand during the altercation. Steve Jacobson approached Frank Carson not the other way around.

Frank Carson had represented AJ Pontillo. Steve Jacobson was accused by Frank Carson of jury tampering, of having contact with an alternate juror during deliberations. Frank Carson had testified against Steve Jacobson due to that contact. He was arrested shortly thereafter and then Steve Jacobson and Dave Harris sincerely apologized and the Judge (McFadden?) forgave them because they were sincere about their apology.

Percy Martinez talked about the Jim Cook information. He says he is an eyeball expert. He uses a protractor and his eyeball. He was paid a LOT of money, in excess of $400,000 to determine cell tower information with a protractor and eyeballing. He did not use any type of scientific methods, like Google maps, to do his mapping. In fact, Jim Cook said on the stand he testified that he had never used Google maps, but then found out he had done it prior to that and sent it to Marlisa Ferreira who was obligated to turn it over. When they did turn over the information (that he said he never did) it showed the Frank Carson property was outside of the overlap that they kept saying it was in. It was about 8 degrees outside. That mapping was done with precise mapping software thru Google maps. The last day Jim Cook testified he admitted Frank Carson’s home was not in the sector it was in.

Percy Martinez talked about James Emile again. He checked the clothes. Robert Woody had said he had cut the fingers and toes off, because they don’t want fingerprints. The prints on the toes are the same as on the fingers, according to Robert Woody. So he cut off the fingers and toes and through them in with the body. He put the shoes back on his feet, after he had cut off the toes and according to Robert Woody, there was blood everywhere. When they examined the boots, they found no blood. There was a discoloration, but it could have been organic vegetation. They didn’t find any on the clothes or boots. He says this is hard evidence that contradicts Robert Woody’s testimony. He said all the evidence points to these defendants being innocent and if you can’t believe Robert Woody you’ve got nothing.

He said there were two shots fired into the coat, according to Faye Springer, but Robert Woody only heard one shot. Robert Woody also testified there was no jacket, Korey Kauffman was only wearing a t shirt with a logo on it. He says Robert Woody would have seen the coat when he cut the fingers off. Again, that is hard evidence that Robert Woody is lying.

The bullet had Korey Kauffman’s DNA on it and the full profile of an unknown person. The DNA was checked against everyone that was suspected in this case, including Mike Cooley and it matches nobody. The bullet came from a rifle, not a handgun. It was a Marlin Rifle, but Robert Woody never saw a rifle only a handgun. He also said Robert Woody said the fingers and toes had been cut off, but on the skeletal diagram, they showed that the hands and feet were missing in totality, not just the fingers and toes.

Percy Martinez talked about Dave Shaw. Det. Shaw said Mike Cooley said Korey Kauffman was going down Lander Street, he was heading the opposite way of the Carson property. Mike Cooley never said Kauffman was going to Frank Carson’s property. Mike Cooley said pipes were stacked on the other side of the property, about 5 ft from the fence and MIke Cooley did not point out the hole, because there was none at the time. Dave Shaw said he saw no hole on April 2, 2012 when he talked to Cooley and he didn’t see any pipes stacked on the other side of the fence. Percy Martinez also said that Shaw said, that Mike Cooley ever mentioned anything about pipes on the other side of the fence. That was something that was brought up later.

Percy Martinez talked about Praveen Singh. Praveen Singh had testified in Federal Court and said he was a Reserve Police Officer with Fresno Police Dept. Fresno said they had never hired him. One witness, Billy Dishman, had seen a full uniform with leather gear and vest in his house. Praveen Singh had also made comments to investigators like “Frank Carson’s boat is sinking, he’s not going down with Frank Carson”. He also said “he didn’t know sh** on Korey Kauffman”. He told investigators “they need to work a deal”. Kirk Bunch told Praveen Singh that Frank Carson had put him in this position, which is similar to what he had done in the Micah Dizney situation. Praveen Singh said he “didn’t give a f*&^ about anyone, including Carson”. Praveen Singh also stated he’d “given up family members, so he was more than willing to give up Frank Carson”. He told investigators he didn’t want to sit in jail for many years to come. Praveen Singh said Frank Carson had denied any involvement with Korey Kauffman. Frank Carson denied any activity with the Korey Kauffman case. Praveen Singh had multiple charges with the State and the Feds, most of them felonies. Percy Martinez said Kirk Bunch had mentioned to Singh, it’s done and over with for Frank Carson, they have his number. Percy Martinez said Kirk Bunch had manipulated many people in this case, that is what he’s done and he does it well.

The jury has heard all the different stories on the stand. There is a long history with Frank Carson, Kirk Bunch and the DA’s office. Percy Martinez said the fact that the defendants have been charged, that fact alone, is not evidence in this case. The information brought out in this case is. They have to be found guilty beyond a reasonable doubt. Anything less than that is a not guilty verdict. The court will explain the circumstantial evidence situation that is involved in this case. Percy Martinez said the expert testimony or the lack thereof shows Robert Woody is lying. With circumstantial evidence you can convict if it is the only reasonable conclusion. The jury must accept only reasonable conclusions.

They heard Mike Cooley’s statements that he made to Charlie O’Dell after going to Escalon when he picked them up after the car broke down. Percy Martinez said Kevin Pickett had come over on March 30, 2012 to the Cooley property and there is more circumstantial evidence that Mike Cooley committed a crime because Mike Cooley and Eula Keys were acting funny. If you reject Robert Woody’s story you have to find them not guilty. He said why would the Athwals kill somebody for Frank Carson? The only contact that Robert Woody had with Frank Carson was on 5/23/3012. There is no other contact or phone calls.

During this time, Marlisa Ferreira was making a few objections. The Judge sustained one or two, but mostly she was advising the jury that argument is not evidence and they need to determine if it misstates the evidence or not. Also at this time with all the objections, Jai Gohel requested a sidebar and Judge Zuniga told him no.

Percy Martinez stated Frank Carson was going to the flea market on Tuesdays. Most of the cell phone evidence and the locations of the phones, they are saying Frank Carson is at Pop and Cork,but they are Tuesdays and the connection between them are every seven days. More objections from Marlisa Ferreira.

Percy Martinez says the only time Korey Kauffman’s phone was on was when Eula Keys had called the number. Why?

Korey Kauffman was shot with the jacket on two times by a rifle. That is the facts. That doesn’t change.

Percy Martinez argued people are entitled to carry firearms on their own property and own houses. The evidence shows Robert Woody is a liar and they must acquit.

Percy Martinez went into Michael Maunakea testimony. He told a story in regards to Korey Kauffman recording a statement in case something were to happen to him. Maunakea claimed law enforcement took that recorder in a search they did. Korey Kauffman came over in September 2011 and he wanted a gun back that he stole from Frank Carson. Maunakea said Kauffman worked for Frank Carson. All these were lies. Maunakea said that Turlock Police Dept was trying to kill him. There was a blurred picture of a cell phone that Maunakea was directed to look at on the stand by Marlisa Ferreira and he started crying and noted that was the recorder that was confiscated from his house. Percy Martinez said the next day they received a clear picture from the DA’s office, that they had all along and it was a clear, colored picture of a cell phone, not a recorder.

Percy Martinez said prosecutor’s have much power and money and are able to do as they please and file charges. Officers have testified that no recorder was ever taken from the Maunakea residence in any search. They had copies of the receipts. Marlisa Ferreira used a blurry photo of a cell phone and convinced Maunakea it was a cell phone. The lives of three men are at risk with this type of activity and playing with the evidence.

Kevin Pickett was interviewed and Kirk Bunch never wrote a report on the interview. He also said he destroyed his notes, after a lengthy questioning on this area and finally admitted he destroyed his notes, after not knowing what happened to them initially. After Kevin Pickett said Korey Kauffman disappeared on March 29, 2012.

Percy Martinez talked about the definition of intent of conspiracy and obstruction of justice. There is no obstruction, he says, by people going to Frank Carson for help with legal problems because he is an attorney. Frank Carson always says, don’t talk to law enforcement, but if you do, don’t lie.

Percy Martinez also noted there was no cause of death of Korey Kauffman. Nobody knows what he actually died from.

Percy Martinez talked about Officer Ken Briggs who field interrogated Frank Carson on the corner of Lander Ave and Montana. He was surveilling his own property, he says. Marlisa Ferreira said he was watching Mike Cooley’s property, but where Frank Carson was sitting he could not see Mike Cooley’s house. He could see the front house, but not the back house (Mike Cooley’s house), but he could see his own property and the fence line. After Officer Briggs had said that he’d gone to the scene to relook at what Frank Carson was looking at and he testified what he saw and Marlisa Ferreira attacked him for doing what he did to be correct in his testimony. He wanted to confirm to himself. She also attacked him for chewing gum, BTW.

No pipes were ever found on the Carson property. He told the lamb stew story – that is how he finished it off. I can’t remember it all. If you are going to eat lamb stew and that’s all they’ve got, it is just a little bit of meat, the meat is rotten in the stew, try to find the meat that isn’t rotten. He’s telling the jury not to look at the rotten meat, look past it and find out what the real story is.

Percy Martinez was done with his final arguments. It was about 3:30PM. It was really hot in the courtroom. The room got warm quick. Tomorrow we are back at 9:30AM. Attorney Hans Hjertonsson will do his final arguments. He says he isn’t going to take all day. Jai Gohel will do his argument on Friday. Judge Zuniga is checking in and told the jury if they are able to be in court on Monday. She’s going to check with Court Administrators if she can have court. She wants to get this done. She told the jurors if they don’t have plans to let her know. If they do have plans don’t change them, they will come back Tuesday. There is another court in that courtroom on Mondays.
